The marriage certificate will show the marriage date is after the date claimed on the application.    USCIS will more than likely ask for the first marriage certificate.

 

There is no out of this predicament, from what I have seen.

This process will take a long time and when it is done you will probably qualify for IR1 visa as opposed to having to go through adjustment and ROC. Also, make sure you have proof you are free to marry- if issue is they believe you are/were married to someone else. 

 

Hi Alex

If your DV application was denied for fraud ( like if you won aDV and added someone as your wife after winning the DV so she could benefit from it ? ) you may still be able to marry a U.S. citizen and apply for an immigrant visa. However, it should be noted that the U.S. government takes immigration fraud very seriously and may review your application more closely if you have been previously denied for fraud.
You should consult with an immigration attorney to discuss your particular situation and determine the best course of action.
