Hello everyone,

   My aunt  got married 9 months ago to her  husband who is a US citizen. My aunt lives in Ghana.

  A friend told me instead of filing  for a petition for her while she is outside the US, she can rather apply for a fiancée visa to visit him and then her petition filed when she is in the US.


  Is this true? And will applying for a fiancée visa get her to the US faster than filing for a petition whilst she is outside the US?

This is not true. Because they are already married fiance visa is no longer an option for them. 

They will have to file the I-130.

Your aunt can apply for a tourist visa to the US but she cannot visit the US with the intention of adjusting status.

No. K1 takes 2 years

 

 She’s ineligible though as she’s married

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Your friend is giving you incorrect information. Your aunt doesn’t qualify for the fiancée visa anymore because she is married now.
 

Maybe your friend was hinting that your aunt should try to get a tourist visa and use that to enter the US and adjust status, which is terrible advice and visa fraud.. Your aunt will have a tough time getting a tourist visa approved.

 

Please tell your friend to stop giving people immigration advice because they are providing incorrect information! It’s a good thing you checked here.

that is visa fraud

if aunt wants to live here,  the USC must apply for the spouse visa

The initial plan is to file a petition and follow the normal procedure anyways. Just needed clarification on what I was told. You are also saying getting a tourist visa and then adjusting status whilst in the is also not advisable? Thanks a lot!

Very unlikely she’d get tourist visa.   Just do things the right way and file the correct petition.   Why would you even consider filing the wrong petition???
