Whichever  of her parents is willing to go to Helena for the interview should be used as the grand parent providing the necessary 5 years of physical presence.

Cool. If his N-600K interview does not happen before his authorized stay expires, he can come back when  the interview is scheduled.

 

Forget about IR-2. 
 

And so the CO did not lie, but the CO was not forthcoming. IMO, the COs who do visas are not up to speed on U.S. citizen issues.

I saw a case where mom did IR-2 for her son, and promptly did a U-turn back to her  country of birth with the kid. The passport agency did not like that at all.

3. Regularly resides outside of US

4. She has custody 

5. Grandparent has 5+ years physical presence is US

6. Child can re apply B visa to come for interview

In his passport the visa expires Dec2023 is that the date he has to leave or the date that he had to enter?

December 2023 is the last day he can use the visa to enter the U.S.  

 

So file N-600K now. And then re-enter U.S. before the visa expires whether N-600K interview is scheduled or not.

If you have his visa you have his passport. If you have his passport, you can get his I-94 online. You are online because you are posting here.
