I have to provide work authorization by Monday and don’t have any extension notice! (merged)

Hi all - I am in an issue where my conditional green card expires July 27 and I start a new job, July 31. I have already applied for my removal of conditions June 9th and am crossing all my fingers and toes that the notification comes before July 31st, but have no guarantees as I am dealing with USCIS after all. I am wondering what other options do I have? Couple I can think of:

 

1. I have applied for an unrestricted SSN and am hoping to use that for I-9 verification as a last resort. However, I imagine when my employer uses e-verify, if USCIS has not processed my I-751 application by then I would not be employment authorized at that point? 
2. I’m wondering if I should ask my employer to start me earlier. I just don’t want to ask something like “is there a possibility I can start earlier due to my conditional green card expiring July 27?”
3. I could just delay my start date which is something I would rather avoid doing!

 

Any insights or experiences with this would be greatly appreciated!

Employers may not specify which form of ID and work authorization you submit.

Okay I see - don’t they use e-verify to make sure you are authorized to work in the United States though? Would this come back as unauthorized if I do not get my conditional green card extended?
 

I just applied for my unrestricted SSN and should have that hopefully within the 2 weeks they said I would.

I would assume e-verify would make it simpler.  You should be in the system as authorized to work and that you are still an LPR while your ROC is pending.

I did a self check and it showed that I am authorized to work! I imagine it will remain that way as long as USICS at least processes my file by then.

You do not require work authorization as GC holder. And you will remain LPR as long as an immigration judge doesn't take it away or you voluntarily give it up.

Yes.

Just need unresticted social security card and valid ID. Even conditional GC holders in removal proceedings continue working AFAIK.

Per this January, your I-751 receipt notice serves as proof that your GC is extended by 48 months (4 years!) - so in case you're worried, I'd bring a print-out / the actual mailed notice as well as this page and show it to your employer (you'll also need to bring the receipt notice if you're using your GC as identification)

I'd advise absolutely against using your Greencard and the extension letter if you have other means to satisfy the requirements. Many employers have no idea about the whole thing and it might only give you a headache. 

 

If your SSN comes in time use that and your DL. Check the box that says lawful permanent resident on the I-9 and don't talk about conditional Greencard and ROC. 

This is the best advice.  In general, do not tell more info than what's needed about your immigration status, it will confuse them. Learn your rights.

So I filed my I751 application, which was received by USICS June 9th. Today I got in the mail my USCIS online account access code and biometrics reuse letters, but no extension.

 

My employer just emailed me saying that I need to provide pictures of what I will be using for work authorization for my I9 by June 26. My green card expires July 27 and my job starts July 31 so I cannot use that! I applied for an unrestricted SSN June 12, 2023, but do not have that yet. I also do not have my extension notice yet. I called USICS and spoke to Tier 1 who scheduled me for an infopass appointment as they are saying an extension notice was not issued for my case. Is my best bet to wait for this “urgent” appointment? What are the chances I can even get a stamp by Monday!

Is there an online copy in your USCIS account?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
