Do you recommended, getting a new i-551 first? Or can I still apply for passport even if they weren’t claimed on the tax?

How does he prove they live with him without an SSN? Without that proof, no N-600. No passport.

 

The entire situation defies credibility.

I’m sorry I don’t understand, so he won’t be able to get a passport or a new visa stamp?

Yes, but they never got their social security cards mailed. And after applying twice for the green card they didn’t get anything. He has proof that he applied twice for the green card, and paid the fees.

The kids are not U.S. citizens unless they lived with their U.S.  Citizen parent. What evidence is there that they lived with their parent?

School records, Medical records would that be enough?

Why did he not file taxes with them as dependents, leaving off the SSNs?

 

They only arrived in 2021.  He can amend his tax return for 2021 and 2022.  1040x.  And state return too.

 

He will get money back.

People misunderstand this all the time. You can only file an N-600 once but if it is denied you can file an appeal within 30 day or file a I-290B after 30 days. You can present all the evidence you didn't include in the N-600. It is not a one shot and you are done situation. 

My wife came to the US on an F1 visa about 10 years ago.

True - but how many people here miss their notices, or don’t reply in time.

 

What happens if the appeal is denied? New application allowed?

You just file an I-290B. That is a motion to re-open or reconsider your case.. Yes it costs about $700 but that is half as much if they allowed you to file a N600 again.
