I'm a citizen, my kidsnwere born abroad. 

I'm now int he usa and want to file their petitions. 

What is the way fwd?

Do they need to apply for the green card?

Without lawful permanent residency aka green card status, they cannot be citizens.

They are on visit visas. B1 b2

You must focus on filing I-130 / I-485 / I-693 / I-864W for the  16 year old now. Your husband and 13 year old are lower priority.

 

If your 16 year old’s I-485 is approved after each reaches age 18, he will have to wait until at least age 23 to file N-400 to become a citizen.

 

But if I-485 is approved before he reaches age 18, he will be a U.S. citizen. 

 

1. How close is he to age 17?

 

After you get I-130 and I-485 receipts, file his I-131 and I-765. You will want to also request an expedite for your 16 year old’s I-130 and I-485. 

 

Next priority is to file I-130 / I-485 / I-693 / I-864W / I-131 / I-765 for your 13 year old. Expedite not needed yet, if ever.

 

In their I-864W filings show evidence each child lives with you.

 

After the kids are filed, you file for your husband.
