Timeline

The sponsor portion and the required forms always seem to be the tricky part of the process. I did a little research and could not find the answer.

 

My wife has petitioned for her mother. However my wife has only recently started to work again as we've had 2 kids in the last 3 years. 

 

As the petitioner, must my wife fill out the I-864 and must I also file another one as a joint sponsor?

Since I would be a joint sponsor, is only one I-864 needed?

Is I-864A needed?

 

We have filed taxes jointly over the last 3 years.

 

What is the correct procedure?

It appears that this was an extremely difficult question that stumped all the visa journey members.

I'll see if calling USCIS will be of any help. I may call 3 times to see if I get consistent answers.

I guess that I will research this a bit more and decide on what to do. 

After all, the worst that can possibly happen is getting an RFE if the wrong form is sent.

The petitioner is always the primary sponsor even if their income is insufficient.. she completes the I864. As her spouse you are going to combine your income .. she will fill in your details in the “additional household member” section of her I864 and you will complete the I 864a form. Ensure you both have all the required documentation as needed for both forms. Upload everything

There are many many posts asking this question here on vj with full and  correct answers. Search for these threads  See my reply to the OP   It is actually clearly stated in the infotmation pdfs for the I 864.. though i agree that it is complex and hard reading / sorting through it

What i did on mine is click the household member instead of joint member bottom. And we filled up the affidavit of support I-864A and I-864EZ. And upload our taxes back from 2020,2021 and 2022.

My wife is the petitioner. We filed taxes jointly. I will likely have to be a sponsor. What form or forms do we file? 

I am not trying to make this complicated. I just want answers that match my scenario.

As above. As stated in the I864 instructions pdf  The petitioner files the I864 and adds household member  ( spouse) in the appropriate section. Spouse completes the I864A

Just to confirm, if my wife (sponsor) meets the income requirements, I would still have to complete the I-864A in addition the her completing the I-864 because she has only worked a few months this year and has not worked since 2020?

I certainly wont hurt .. as it strengthens   your financial position .. could she be approved  without it.. possibly… but my plan  would be to be better safe than sorry
