I submitted an I-130 for my spouse online. One of the questions they ask is if the beneficiary will need Adjustment of Status and I replied no (they would be interviewing outside the US).

My spouse is now in the US on a visit visa. Its been a month since I filed the application and the only correspondence I received from USCIS is a "Receipt Notice" so far.

Is it ok to file I-485 even though I declined initially or just let the I-130 process and not give USCIS a reason to make things complicated for us?

Print I-130 receipt and mail it with the rest of the docs. 

 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Hopefully your spouse did not lie to CBP about intention to 'visit'?   Spouse needs to be okay with not being able to travel or work for ~8 months, FYI.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

They did ask how long is she here for and she said a couple of months and she does have a return ticket. She recently got released from Army so not worried about travel/work.

Just an fyi, we also have a 4-month old (born abroad) who is a us citizen cuz of me.
