Re: CR1 Visa

Can the Petitioner of the I-130 submit other forms concurrently? Such as I-864? If so, can someone beak down what forms can be added besides the

I-130A?

Also, do I have to date the I-130A or leave the date blank along with blank signature? Thanks!

Only submit the forms they request for filing the petition.

You only submit I-864 if you are planning to adjust status and beneficiary is inside the US.

I am…but the I-130A says the beneficiary doesn’t have to sign (if overseas) however do I have to date that document or leave it blank? No date and no signature?

Then why ask if you can file I-864?

The signature section is:

Spouse Beneficiary's Signature

6.a. Spouse Beneficiary's Signature (sign in ink)

6.b. Date of Signature (mm/dd/yyyy)

If there is no signature  in 6.a, then entering a date in 6.b is not needed.

If 6.a was blank and 6.b was not blank, I would expect dire consequences ranging from an RFE, to USCIS thinking you do not want consular processing.

Any reason why you are not filing I-130 online? My understanding is that it does I-130A as well.

Thanks Mike. I was going to just mail the packet in because I have a lot of evidence to provide and the text messages and pictures would be a headache to upload.

I asked about filing other documents because Ive seen some people filing concurrent packets. I was wondering if it was possible for I-130

Concurrent packets are for when the beneficiary is inside the U.S. and wants to file I-485.

Re: CR1 Visa

You said you are pursuing a visa.

Where is the beneficiary today? Inside the U.S. or outside the U.S.?

Again, words mean things.  You asked about filing other forms, not filing other documents.  A "concurrent filing" IS about other forms but it is not applicable to a visa case.  File the required forms according to the I-130 instructions.  Other forms are filed later in the process, not NOW, so not "concurrently".  You WILL file "documents" in support of your I-130 and I-130a "forms".

Facts are cheap...knowing how to use them is precious...

Outside the US. Got it! Thanks for the clarity.
