Hi, i have a friend that is an american citizen and she's married to a illegal immigrant from mexico, they both live in the U.S. they have a marriage license but they haven't applied to a green card or change of status. Can someone tell what they will need to do to get process started?

They file the spousal visa petition like everyone else. They must tell the truth on all forms. (It will still be approved).

Once they have an interview date in Ciudad Juarez (12+ months after the case has been received there) he will interview. He will be denied due to his illegal presence and if eligible, he will be allowed to file a 601 waiver. She has to write an in-depth and detailed hardship letter with documentation and evidence to prove extreme hardship in the event his visa is denied. They can find information on the Ciudad Juarez website regarding waivers. They should also read the information about waiver processing via the Ciudad Juarez Pilot Program, as well as attorney Laurel Scott's 601 immigration guideline memo on her website: www.visacentral.net. It would also be wise to have a phone consult with her or another experienced immigration attorney who has worked with waivers in Ciudad Juarez to be sure they understand the steps clearly and know exactly what they are facing.
