It seems that my church has failed to file the marriage paperwork with the county. I'm not sure how this is true, because we included the request for the marriage certificate in with the church's paperwork and they seem to have the request but no legal proof of marriage.

So, thank you, Catholic Church, for once again f*cking up my life. First I delay the marriage six weeks after entry to go to a dumbass pre-cana class, ensuring that C. won't be able to work continuously. At a minimum, now we've missed the fee deadline. And quite possibly, we're not legally married.

C.'s going out of town for work and won't be back until the 23 or 24 or so, right when his K-1 expires. If we get married outside the 90 days, hypothetically, how does this affect AOS?

If you aren't married within the 90 days you have to file an I-130 and cannot file for AOS based on the K1 visa, it will be based on a marriage within the USA. I sure hope you get this fixed, and maybe you can just push the priest around a little instead of killing him ;)

That's what I thought. We're already out an extra $250 with the fee increase, and an extra $10000 in opportunity cost because they wouldn't let us have a civil ceremony in May to keep up C.'s work authorization, and if I have to file an I-130 on top of all of this THIS will be the reason I tell St. Peter when he says why haven't you been to church since 2007.

If you have to get re-married and it is outside the 90 days you will need to file form I-130 along with AOS.....

You will have to file for AOS as an immediate relitive, you will need to file form I-130 along with the AOS packet... after July 30th this will cost $1010.00 for AOS and $355.00 for form I-130...

Well technically you were married. So push them and stand in their office until they fill up the papers properly. Then ask them to give them to you and go to the register of deeds, don't trust them to do it if they already messed things up.

They should have signed the marriage license, get that document.

Maybe you can get your signed marriage license, go to the courthouse yourself to get the certificate and certified copies? That's what we did....

I live 500 miles away from where the marriage was performed. I'm not sure the marriage counts if the license isn't submitted with ten days of the ceremony.

Sorry to hear about that. Can't the church submit the paperwork now based on the original marriage date? I mean, you guys *did* get married. You all have witnesses and the priest performed it right?

That's not true.

I got married on a Friday in a church & the priest gave me his signed copy right then so I could take it to the courthouse myself on Monday! Wasn't an issue.

Uggghhhh.... Caladan, I have no useful or constructive suggestions (other than the suggestion that I think a bit of light priest-killing might not be entirely unjustified here) to add, but just wanted to say I'm so sorry you're having to deal with this unnecessary ####### - that shouldn't happen!! :angry:

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Caladan, I echo what featherB says above. On the plus side, churches as a rule tend to be full of sharp implements which can be used to cause maximum discomfort to men in skirts.

Seriously though, if this is going to cost you a fair bit of extra money have you thought about pursuing some form of compensation from the church? They've messed up BIG time and, after you've explained just how much their little ** up has cost you, perhaps you would be in line for some sort of pay-out. Only fair...I don't see why you should have to shoulder the cost. ;)

Depends on the church really. This is the first time I've heard of this particular issue on VJ, so I don't think you can really say "church weddings are bad" because of Caladan's unfortunate experience.
