hi fellow VJ users, have a confusing question and needed feedbacks.. I am a USC and filed for my dad's petition before fees increase, I have younger siblings back home below 21, 14 and 17 years old, can they be included in my dad's petition as his dependents since they are still minor? if not, how could my siblings immigrate here faster? i know it takes 20+ years for siblings of USC? any other options for me? thank u all guys!

12/07/2004... Marriage date

12/30/2004... I-130 sent as LPR

01/12/2005... I-130 NOA 1

01/22/2007... filed for Naturalization

04/04/2007... Naturalization Interview

06/05/2007... Oath ceremony, I-130 upgraded to IR/CR1 spouse of USC by phone and letter

06/11/2007... I-129F mailed out to Chicago address

06/18/2007... I-129F NOA1 received in mail

06/25/2007... I-129F forwarded to California Service Center

07/12/2007... I-130 approved, lawyer as choice of agent (37 days after the upgrade)

08/13/2007... IV bill and AOS fee generated

08/27/2007... IV bill and AOS fee mailed (next day delivery)

09/03/2007... IV bill and AOS fee entered into the system

09/27/2007... AOS and DS230 arrived in mail

10/03/2007... AOS and DS230 mailed to NVC

I called USCIS and they said I would have to put in a separate application for my brother and judging from the information for NVC, he would need a separate application for him to be processed. They told me that I can request that my brother be processed at the same time as my father, since he is a minor, but there is no guarantee that the request will be granted. I am tempted to wait until my father becomes LPR and have him file for my brother then, since I don't want him in the immigration blackhole. :wacko:

12/04/2007 - Receive Welcome Letter

12/14/2007 - Received 2nd Welcome Letter and Green card!!!

Siblings require their own petitions.

So if you wanted them all to come together, you would file for the siblings first and then just before their dates were due, add the father in with a request that they be interviewed at the same time. You have 6 months to activate the visa so this should not really be am issue.

I am assuming no parent would leave minor children, older unmarried childen can be petitioned by the parent once they have the Green Card, but they must mantain their Green Card status.

I think it was because petitions under IR category cant have dependents, i dont know, Im not sure why, maybe because it is being processed faster and not on family preference categories, i am thinking about filing for my siblings too then see if they can be processed at the same time as my dad but i wanted them to get a visitors visa and it will be impossible if they have pending I-130, your brother is still young and your dad can petition him when he gets here but my sisters are teens already, even if my dad files for her, (the 17 year old) she will be over 21 when they process it, so i realy dont know, we are both lost so cant guide each other.. hope we could get some good advice..

thanks boiler! but im a bit confused, what do you mean by when their dates are due? is it when their processing time is current? as far as i know the waiting time for siblings of usc is much longer than that of the parent..

thanks boiler! but im a bit confused, what do you mean by when their dates are due? is it when their processing time is current? as far as i know the waiting time for siblings of usc is much longer than that of the parent..

A parent does not have to wait for a visa number, a sibling (and others) do.

So you would wait for visa number to be current for in this case a sibling and then file for the parent so they could all come together.

Assuming that is what you want.
