Timeline

My fiancee's visa expires on Aug 2. Unfortunately August 2 is not a weekend and we are missing this last weekend Saturday July 28, before the visa expiration date. How strict is USCIS if we are married on August 4, two days after visa officially expired? I know we can get married on business day, but ... Did anyone have have such experience - being married just after 90 days?

Your legal requirement for entering the States on a K1 visa was that you have to get married before the 90 days expires...and file for Adjustment of Status...

I would be too scared to get married after the 90 days...My way of thinking is .. if you get married after the 90 days then apply for the change of status you could be denied because you didnt uphold the legal requirement in the first place....and even worse you fiance could be deported back to Russia...and you dont want that to happen im sure...

I might be way off here but please get married before it expires to be on the safe side ...

If anyone else has any other info to help this couple please add...

ps if your planning on a big wedding why dont you go to the court house get your marriage licence and have a court offical perform it..just to show you performed the legal requirement for USCIS... then down the track have the big wedding..

REMOVING CONDITIONS

11th Aug 2008 - Mailed I-751 to CSC.

12th Aug 2008 - Application received

14th Aug 2008 - Cheque cashed

18th Aug 2008 - Received NOA-dated the 12th

26th Aug 2008 - Received Biometrics letter

4th Sept 2008 - Biometrics-Detroit-Complete-'Touched'

5th Sept 2008 - 'Touched'

1st Dec 2008 - APPROVED-Card production ordered -112 days

8th Dec 2008 - USCIS mailed approval notice.

8th Dec 2008 - Received my 10 year Greencard in the mail. took 2 days.

Although I have the above date for approval my card actualy states the

2nd December..

I think it is not impossible to marry after the 90 days, but I am always amazed when this question comes up. Why are so many people have trouble to stay within the 90 days? I mean...90 days, 3 months..isn't that time enough to find a day to get married, and even it's just signing the papers at the JOP or so?

I am aware there are many good reasons why people wait or have to wait or whatever, but still..you agreed to get married within the 90 days upon arrival, it's not like they are only giving you a week to get married, then I would understand that people are not able to make it in that time, but 90 days??

I don't know, it just makes me a little uncomfortable when so many people are trying to get excemptions made to their cases but then are surprised and angry when USCIS is not processing cases within a certain time either. (Not that they are always processing cases in a timely fashion even IF you marry within the 90 days, but you get my drift?)

I think I will get some beating for this... :unsure:

If you fail to get married within the 90 days given with a K1 you will be out of status and will no longer be able to file for AOS as a K1 visa holder....

You will have to file for AOS as an immediate relitive, you will need to file form I-130 along with the AOS packet... after July 30th this will cost $1010.00 for AOS and $355.00 for form I-130...

I agree 100%. What is the problem anyway? If you are having second thoughts, send her back to the Kremlin. If you two were actually planning on being together, then I can see no reason why people cannot comply with the law.

Discussions as to why people can or can't get married in 90 days are irrelevant here. The fact is, as others have stated: If you can't make the 90 day deadline you have to file I-130 as well.

So its not a weekend, take your lunch break, go to the courthouse and get married. atleast you will stay within the required 90 day period.

What part of the 90 day rule did you not understand.

Yes of course there is an issue if you marry after the 90 days.

You have to file different paperwork, and plenty have done it so it is not impossible.

Legally, when you got your K1 visa, you promised to get married within 90 days, not 92 days or 91 days or anything other than 90 days or less. To avoid extra money being spent and extra hassle, just go get legally married at the courthouse before those 90 days are up.
