filing for k-3

hi all just would like to know is it really true you dont have to send in the I-129f form if filing for a k-3

the reason i asked i call the uscis csc office to find out where my notice was still havent recieved one for receipt of papaer recived at csc on june 11.well to make long story short talked to women there said i didnt need to file the I-129f i still dont understand i know it has to do cr1-ar1 visa and not having to file for aos after my wife gets here but i am not sure how all this works and feel really DUMB all i know is i have to wait longer then any of us have to or should have to.

so any one or all respond and let me know what to expect. looked ay processing time and if there working on december 06 and it is almost aug, 07 so that would mean 8 months from now they start working on june 07 paper work and another 6 to 8 month from then then my wife can come so another 1 1/2 yrs from now she would get a visa ??????

Please read the guides.

To pursue a K3, you must file an I129F petition (and you must have either a previously file I130 pending or must file the I130 at the same time as the I129F).

If you only file an I130, you spouse will be able to eventually apply for a CR-1/IR-1 visa (not a K3). The CR-1/IR-1 means your spouse will not have to go through AOS, but it will most likely take longer for the whole process.

Again, read the guides for more details on both the K3 and CR-1/IR-1.

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

I was told that it's a ####### shoot. you may or may not get your spouse here faster. and from looking around this site I would say that is true.

Now days, there is only a 1-2 month difference between a K3 and CR1/IR1 visas, for most embassies and for most cases.

But anyway, I think what the USCIS was trying to tell you is that you don't need an NOA1 for the I-130 to file an I-129F for a K3 visa. Again, you DO have to file the I-129F for a K3 and if you don't have the NOA1 in your hands, then you can write the receipt # on the cover letter that you send along with the I-129F. What the USCIS needs to know is that you have already filed the I-130 and the receipt number is one way of proving that you have.

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Yes, a K3 visa requires both an I-130 and I-129F to be filed. CR1 or IR1 requires only the I-130. Please study the appropriate guides.
