K1 is a non-immigrant visa, it’s only on the website in which you’ll have to pick immigrant then when it’s at the consulate it’s referred to as non-immigrant again, also you could fill out the DS-160 form till your case is shipped to the consulate in next weeks shipment tuesday/wednesday.

NVC Timeframes (state.gov)

 

This site is pretty accurate, its saying that your case was just created this Monday, and then follow the case review time date to get a good estimate on when they will be done and send it out. then you can check the shipping dates but they will send you an email when they send it to the consulate. keep up the inquiries and you will get more info, don't be discouraged if they make a mistake and say they haven't received your case during a response, they can say that sometimes and when I asked for clarification, I got my case number and everything immediately after.

 

Sounds like you already have your case number so thats awesome. they are really moving fast now!

K1 is by all means immigrant visa. Because the purpose of it is to convert to permanent resident after 90 days. And yes MNL stands for Manila. NVC case numbers always start with three letters representing the city the embassy is located in.

I started gathering the supporting files for the interview (police clearance unfortunately takes like 8 weeks in Germany at the moment and I got my birth certificates yesterday) and prepared the information for DS-160. I would recommend you to do the same but not yet submit anything. The prepping helps to bridge the waiting period for me.

For Frankfurt, Germany, the process seems to be to wait for the Packet 3 (emailed or mailed to me) in any case after the status switches to "Ready". @Eddie101 do you have other information on the Frankfurt procedure/have you received the Packet 3?

K1 falls under the non-immigrant visa category as it requires the adjustment of status procedure - this is not the case for immigrant visas. In any case, you're very much intending to immigrate, so you're both correct in some sort. 🤪

Since the purpose of it is to adjust status then it’s not considered an immigrant visa😂 a quick google search shows that K1 is classified as a non-immigrant visa. It’s only for the NVC website which you input it as an immigrant visa then it’s back to non-immigrant when it’s reached the consulate.

Hey, all. No need to argue about that. K1 is a total gray area.
Officially, it's non-immigrant, therefore we need to adjust our status in the US. The intent to immigrate is only implied, fiancés have the option of not really adjusting status/not marrying/going back to their home countries, though we all sign intent to marry letters. It's not like a B visa – intent to immigrate is not considered because it's made for tourism only.

 

Because it's a gray area, we need to file DS-160 like non-immigrant visas and fill I-134 form like non-immigrant visas and adjust our status to permanent resident/immigrant whenever we fill in our visa obligations. But we also are treated as immigrant visas on NVC (we are given a case number, to check the status we have to select immigrant, etc.) and also you will find the immigration visa section of the embassies are the ones processing K1s, not the non-immigrant ones. That's why embassies list K1 as immigrant visas on their websites, and AIS interview scheduling systems do it too.

Congrats!!! That was oddly fast since on august 8 they haven’t even received it yet, fingers crossed that i’ll be hearing back soon since mine was received on august 2

Also the petetioner receives it by email/mail and you need the DS160 confirmation page in the interview.


We were just confused cause we expected something in the mail but only got a digital notice by email. 

 

Medical booked 6 Sep. Interview booked 21 Sep. London.

What about the I-134? I have already gathered W2's, bank documents (signed by a bank officer) and a letter of proof of employment from my employer. Are there any other financial documents that I will need. I have a 401k, would proof of that be needed? As for the DS-160, I think fiancée once tried to fill one out for a tourist visa, but it would never let her finish the process. It apparently has a time limit and will kick you out and make you start over if you don't finish it in time, but their site would load so slowly she could never finish it.

Wait until it says transfer. After that when your embassy have all ready it will say status ready. You start preparing all documents for interview day. And get your appointment day.

Hey guys,

I received my case number from NVC with in 56 days from NOA2 letter June 26- Aug 23 !!!
Now it is showing at NVC when I check the case number in CEAC website.  
Question? How busy are US Embassy at Armenia (in general can I find out how busy are embassies) ???and how fast they process and schedule interview for K1-Fiancé VISA?????

When I will see status change to transit or ready ??????
