Just a quick question for you guys. Hope you can help me. I have a friend who filed for AOS couple months ago. They don't have internet now so, she asked me to find some help online. They recived an RFE stating that they need to submit the proof of sponsors income - pay stabs, W2. But her husband is self employed and doesn't have that. They don't have much proof of current income (pay stabs). Plus his income is just to the minimum limit to qualify. They are confused on what to submit. In the RFE it says they received the notice because either their income is not sufficient or they didn't submitt enough proof of current income and then it lists what they should submit (pay stubs, W2s). Is it a request for a cosponsor?Should they just go ahead and find the cosponsor or is it not what the uscis is asking for and won't do? In the RFE it doesn't specifically say they need a cosponsor. They are really confused now.

Someone who is self employed can easily get an IRS transcript, just ask for a simple transcript for past 3 filing years.

I am self employed and since my last three years of tax returns were from when I was in grad school I had to prove my current income. So, I got all of my clients to write letters that they had paid me X amount of dollars in 2006 and X amount in 2007 and would continue using my services in the future. I also wrote a letter that I was self employed, earned x amount of dollars, etc. I got a letter from my bank that said I had X amount of deposits for year 2006 and year 2007 to date that were very similar to the amount of income I claimed on AOS. I also had everything notorized.

I also sent copies of all of my real estate holdings because even if you don't meet the 125% poverty level your real estate can qualify you. There is a formula they use. That's how I qualified for sponsor the first time with the K1 although I had a student's income :)

Make everything VERY clear. Even do the math for them and highlight everything. If you just send a bunch of paperwork and hope they will figure out your income from that you are wrong. They will send you an RFE. Create a cover letter with everything that is being submitted so they can follow it. THey just want to make sure you are employed and meet the poverty level.

We were approved last week so even though you don't have the traditional pay stubs and the like as long as you can prove your income you will be ok.

Thank you for your responses. The thing is that he was self employed last year and his last years Tax return showed enough income to support them both. This year it's not so good with work for him, and he may not qualify, there's not much income to show as a current income at all. But this is what their RFE is askig for and the don't have much to show. What should they do? Find the cosponsor instead? But the RFE itself doesn't ask for it. Pleasenhelp if you know what to advise.

Last years income is fine, - the RFE has no question about it, like I said. Current icome proof is what it's asking about - his current income may not qualify him - this is the problem. Business is not going good this year and not improiving, he basically has almost no current income to show. Who knows may be he will make a furtune in the ent of the year, and that would make him qualify for this year, but as of right now - they have almost no income to show.
