You won’t be able to get an SSN without an EAD or GC first. So you’ll be able to get a DL either with an EAD or GC.

Sounds about right. Some get it faster, some don’t. Shows 11.5 months on USCIS processing times

in 2018 someone i know came with B1/B2 visa,  stayed in FL and didnt think or just follow whatever other people told him, with i-94 still active he applied DL and he got that DL believe it or not. once his i-94 expired, ICE chased him through phone calls. dont know whats going on because he never got detained or anything after that. seems after that this person applied for asylum. all i know is he is still in florida right now, have EAD from asylum and definitely has DL. 

 

what i'm saying is, unless the rule has change, seems people can apply with i-94 still active even though they came with B1/B2 visa but the DL expired on the day i-94 ended.

 

side note : that someone is not me just in case people wonder

 

as for EAD : OP...the trend is either u got the EAD approved the same day after u do biometric or u wait for months. that's the 2 trends that's been happening since 2022. no idea how USCIS pick and choose which one who got it in a month and the rest have to wait.

Wow that’s crazy. I heard that too with unexpired I-94. Mine is expired though so I guess my chance is gone either way. I know someone going trough same process and their lawyer told them with expired I-94 plus NOAs here In Florida is no problem to get DL. From what I read on vehicle place page that’s not accurate though and from what people say here on the forum it’s not accurate either. 
 

Anybody here who applied for aos this year and can share their experience on how it went after biometrics? Got ead approved the same day or waited for months? (If yes, how many months did you wait?) after my biometrics two weeks ago my status just changed to actively being reviewed. :(

look on reddit. many people reported almost on daily basis. but like i said, the amount of people who posted it probably small amount of real number.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

State laws change, I know mine has to what may have been the case years ago may not be the case now. I know Colorado has changed, so you need EAD for a DL but on the other hand they have implemented a license for illegals so you can get one of those.

 

I doubt Florida has such a license.

 

Could be worse, California gives new residents 10 days to get a license.

 

EAD, well I have seen a few people say they received EAD within 2 months, they seem outliers, 7 or 8 months seems more normal, it is a mess so who really knows.

I was in same position albeit GA.

 

Expired i-94 but no EAD yet.

 

I pointed out I was required to get DL but not allowed to. They said "Just tell the cop - they will accept that"

 

I laughed and said "If he does not, will you appear in court in my defense ?" They said no 🙂

"Can I have a letter confirming I had applied in time but refused until EAD" - they gave me such a letter.

 

Luckily I never got stopped so never found out if it would convince a cop.

 

As soon as EAD arrived, they gave me GA licence with same expiry date.

Hey!

I was pretty much in the same boat. I also am in Florida too! My husband and I filed a little late on the AOS. I did my biometrics a couple weeks ago and then went to go get my FL drivers license. Bring the I-94 regardless if it is expired or not. The worse they can say is that it won’t work, but I doubt it.

Bring your I-797, marriage license, a piece of mail with your name on it with your current address, passport, drivers license from the country you came from, and your US SIN card.

You shouldn’t have any problems. I just did this 2 weeks ago.

Wow, thank you for this! But my problem is: I don’t have a SSN. Did you get your SSN right after biometrics? How long did you have to wait for EAD after biometrics? Where are you exactly in Florida? Did my biometrics three weeks ago and unfortunately no ead yet. Although I heard of many people who got ead very shortly after. 
Are you adjusting from esta? Would be Interesting to know your experience and Timeline since we are both in Florida so let’s keep in touch! 

the funny thing is, many people who live in Florida tell me that I won’t have any problems trying exactly what you said. Seems like what’s on paper and the „rule“ often times in reality looks different. Not saying that it will work for me, just saying that I noticed that talking to people who actually live here, „rules“ just seem to be rules on paper sometimes. But, you had the ssn and maybe they just didn’t care about the expired I-94 that much. Having a ssn seems to be crucial from what I’m understanding

It happens alot right now actually. I know two people personally who filed around the same time like me ( April) and both got theirs EAD approved the same day and the letter in the mail 2 weeks after biometrics. It is happening
