Can I marry in the US to my American Fiance just by crossing the border and then come back to Canada and start CR1 process?

Hi, 

 I am Canadian and my Fiance is a US citizen. We are in a long distance relationship but only 4 hr drive away from the border and we see each other once a month for few days regularly. We want to get married soon and planning to go with the CR1 process rather than the K1 but I was wondering if I can just cross the border with my Canadian passport to get married in the US then come back to Canada and start processing the CR1? Or would it be easier if my American Fiance will just come in Canada and get married here instead?

In Ontario, you have to request a marriage certificate from the province and that can take months.

 

I would get married in the US for that reason.

Thanks for the reply! So they won’t deny me at the border if I say my intention to get married?

Just in case, bring your lease, pay stubs, proof of ties to Canada.

Okay got it thanks so much! I wasn’t sure if I would get in trouble or will have difficulty in the future of re-entering the border when I visit next or once we start processing CR1 as they might think I misuse my entry rights

Timeline

You will do other things besides get married during your trip.  No need to mention marriage at all.  I would use a more generic but truthful answer, maybe the one you use every other time you visit.

We got married on one of my visits to the US. We obtained a license within 24hrs of requesting. I went back home to Canada and we began the process. Just be sure to have proof of ties to your home so it doesn't look like you're trying to stay in the US.
