What forms are required to adjust status from ESTA?

Hi everyone!

 

I recently got married to my husband (USC) in New York City. It was a spontaneous decision but we didn’t want to be apart any longer and tried long distance for a while beforehand.

 

We want to get the ball rolling on adjusting my status from a tourist to permanent resident. However we are unsure of the exact forms we need to submit and how we go about doing them. It seems some forms are submitted online and some by post.

 

1) What forms do I / we need to submit? I understand we should submit  the I-130 and I-485 together but how and where should we do this? I also want to apply for a EAD and travel authorisation to leave the country- what are the names of those forms? Should both of us have a USCIS account online?

 

I’m also confused about what form I need to submit for the medical exam.

 

Some clarity on all of the above would be great!

Timeline

Sounds very spontaneous.  Immigration requires a lot of knowledge, planning, time, patience, and money.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Snarky? Loaded?  Not at all....just realistic, general information.  A lot of new people read these threads. Good luck on your journey.   You have quite a ride ahead.  You have come to the best source for accurate immigration information.

I-693 is the form for the medical.you need to look up for the area you live, which civil surgeon is approved to do those exams for uscis- on uscis webpage is a search option for that. You might need several appointments, if you need several vaccination for example. I submitted all forms I-130.485 and I-765 work authorization and medical together by mail including all the required evidence/ documents.

It's difficult to give accurate advice when the information you provide is inconsistent or incomplete. You've yet to explain why your profile says that you applied for a TN visa.

Not sure why it says TN visa - it must have been a a typo / incorrect submission on the website.

 

I’m adjusting from an ESTA as stated in the title.

Your original post doesn’t sound like you “have everything in place.”

Quick Answer is everything that you would have filed the long way:

I-130/I-130A, I-485, I-765, I-693 and I-864 all together with a cover letter and all of the needed documentation.

It can be a long wait.

 

You can also get married here and continue to visit on the ESTA just by doing the I-130/I-130A.

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I’ve started the legwork but wanted some clarification from the actual great people on this forum who want to help.

Not everyone is completely comfortable to just rely on their own legwork and ask for advise in this forum- that's what it is for. And fortunately there are lots of people able and willing to help , not to judge. So I think, that's exactly what you're doing- asking for clarification, advise. And you will get that- just don't react to criticism.
