N-400 Missing Field

 Share

My N-400 application was delivered a few days ago and currently waiting for my check to be cashed. Upon checking the copy of my application I discovered that I missed the box asking if my spouse is in the military or not. What is likely to happen? Reject and send back or accept and then send me RFE

thanks.

I predict: Accept and RFE.

Get ahead of this:

* if you filed by mail, mail a letter noting the error and send a corrected page. Letter should note case number.

* if you filed online, upload a PDF containing the letter and corrected page

I sure hope so. Does the USCIS ever ignore or even miss such errors?

This is a potentially material issue, since spouses of military have different rules for naturalization.

I am applying for naturalization under a 5 yr rule. My spouse's current employment is listed in other fields so they can see that info if they think of it. If they do cash the check I am wondering if I should just ride it and see if they call me to interview where I can ask to check the box right there... do RFEs significantly delay cases?

For naturalization you will definitely be called for an interview, and the IO should give you the chance to make any corrections to the N400 form at that time if you do not receive an RFE before that.  That being said, it does not hurt to follow @Mike E, suggestions to get ahead of it.

By between 1-3 months, depending how fast you respond.

I cannot say I have enough knowledge of the U.S. military to assert that all deployments will list a military employer at a foreign address. I would not expect an ISO to have that knowledge either.

I think I miscommunicated here. My spouse is NOT in the military. I just forgot to check the box and say no. Spouse is a hospital worker. The form asks for occupation and employer which is filled out correctly in a different field. That said the IO should be able to glance over the other field and quickly learn that spouse is not an n the military but works at the hospital.

I cannot communicate this more clearly.

If there is an RFE this is not the fault of USCIS

I am out.
