Vermont normally is for things that need further investigation.

 

Anything particular unusual?

Does the petitioner have a criminal background?  Prior arrests/convictions related to sexual assault or domestic abuse?

@TBoneTX Do you know if this is because the country is Ecuador?

November 2018 - K1 filed

May 2019 - K1 interview scheduled and packet sent to embassy

June 2019 - K1 interview, approved, and moved to USA

August 2019 - Married

September 2019 - AOS/EAD/AP filed

October 2019 - Biometrics Appointment

January 2020 - AOS RFE for birth certificate received and sent back

February 2020 - EAD/AP approved and got the card

October 2020 - EAD/AP renewal filed

November 2020 - EAD/AP renewal approved and got the card - AOS interview date issued

December 2020 - AOS interview, approved, and GC received

September 2022 - ROC filed
June 2024 - Biometrics Reused
July 2024 - Approved (NO INTERVIEW) and GC received.

We used rapidVisa for the filling and whatnot. All the info we've been reading is that California might be overloaded with cases hence the transfer, other than that I have no idea

Only those petitioners with a sexual criminal conviction or for domestic violence go to Vermont for their cases to die or denial. The reviewing agent can approve if you can prove your case

It should not be a reason.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Certain types of crimes in the petitioner’s background (even if said criminal charges were expunged or dropped) flag petitions to go from CSC to Vermont.  
 

Perhaps such transfers have been related to workload distribution in the past, but in 7 years on VJ, I’ve never seen one that wasn’t related to AWA.

 

Hopefully the petitioner has fully disclosed to the beneficiary anything of this nature in his past….if not, and the petition is approved, the beneficiary will be informed of it at the interview.

So a small update. We found an "evil twin". This person is a sex ofender tier 2. With the same physical descriptions (race, hair and eye color, height, weight, some tattoos) the birthday is different but for a day. This person is 7 years older tho and of course with the same name but is safe to say that he doesn't look like my fiance. Additionally, there is no criminal records or anything awa related that show he (my fiance) has had any issues with the law, besides a speeding ticket that is no longer showing in his registry.

Could that resemblance with that one person be enough alarm to ask him for biometrics?

Yikes, unfortunately it will take some added time to process.  They will probably ask the petitioner to come in for biometrics.  In the end it should be ok,

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Hi again! Would like to share an update. My fiance was asked to go to a biometrics appointment, which he completed this past week. Seeing how other cases went I gotta say that I'm pleasantly surprised by how soon that was asked for. Anyway, I will keep this thread up to date.
