EAD for Parents: Mom got her EAD but dad still waiting but he desperately needs it for CDL renewal

Hello

In January I became a US citizen and in March, my parents have applied for AOS. My mom did not have a SS# but my dad did. My mom received her EAD card a month ago but my dad's case is still in review. My dad desperately needs his EAD approved before 6/17 as he is a truck driver. I will be able to support my parents financially after 6/17 if my dad does not receive his EAD but I know this will stress him out and it will bring him down. He loves being a truck driver.

I know that USCIS works at their own pace and I do not believe we can expedite it as we are probably still within the processing window but just thought I would get on here and see what others are experiencing.

I wish I knew someone who works at the Chicago USCIS office but I don't think that would help (asking the person to look into the status of my dad's case).

Thank you.

I have seen some people get EAD's super fast, but that seems to be unusual and your Mother got lucky.

Most people seem to be stuck in the 7 or 8 month range. Mind you I have also seen those waiting more than a year.

He must have had some sort of basis to get a CDL in the first place, can he not use that to renew?

Unfortunately not. He got lucky that he was able to renew it the last time but since then, the requirements for CDL have become tighter.

Well I am not sure what that means.

Anyway he will just need to wait. He can always apply for an expedite but I would not put much hope on it.

I'm curious.  On what basis did he obtain his CDL originally? Why can't he renew it?

I believe that he went to a different state to renew his CDL but now the requirement to renew CDL is US citizen, LPR or EAD

What authorized him to work until now?   As @Boiler said, expedite.

No.  That, alone, does not.

Well no, a Social Security number is for Social Security.

He would have had a work visa or something.

Well, I do not know then but he has always held a job. The difference now is that renewing your CDL requires certain documents as I have mentioned above.

@Boiler and @Crazy Cat are correct. SS alone does not grant work authorization, you have to have either an EAD, GC, work visa.

I doubt they will expedite a case where an applicant has been working without proper work authorization, i.e illegally.

A lot of people in this country hold jobs, pay taxes and they do that without work authorization.

Well it may or may not be relevant what he has been doing, the disturbing issue is that you do not know.

On what basis did he enter the US?  I am asking because it could complicate matters.

Yes, I know that. My dad has been doing his taxes for a long time now. And I understand your statement about USCIS not expediting my dad's case because he hasn't been working with proper work authorization. But to my dad's defense, he has always done things legally. He held a job as a janitor at a Chase bank, and I would think that they wouldn't hire him if they believed it was not legal but it seems to me that the requirements to work legally are wishy-washy.

All of this aside, I am just worried that he will not get his EAD in time and when I say I am worried, I am worried for his mental state. He will stress about this. That is all. I know every case is different and some cases get approved quicker than others.

Tourist Visa in 2001.
