However, it is true that there are LOTS of false and frivolous VAWA claims.  You can read loads of appeal denials on the USCIS AAO decisions page.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Vast majority of the decisions are denials of the appeal.

I don't understand how this happened: "without him or his family ever realizing it, someone had filed an application on Velázquez’s behalf for a visa offered to victims of abuse". Don't you have to sign an application?

 

If Velázquez can't read English and the lawyer provided him with a false translation, then I think Velázquez has chances of returning to the US. If he can read English or was provided an accurate translation of the application, then I don't see any chances of him returning to the US.

I thought this was an interesting case.

 

It appears he applied for DACA on the basis of being abused by his presumably US born son.

 

Obtained AP

 

Travelled on that AP

 

Case was rejected at some point before he returned.

 

He was able to board his Plane but refused entry.

 

Not sure how the U Visa comes into play. that was not explained.

 

Could a U Visa be used if they go after the lawyer and need victims to testify?  Regardless there is a bit of a backlog.

I read that article yesterday morning.  They focused on what they called a "scam" by the attorney, but I think they totally ignored the original scam.  The guy was an illegal border crosser.  Personally, I don't think he deserves a GC.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Reading between the lines of these reviews seems like the lawyer promises speedy work authorization, ability to leave the US and SSNs for applicants with EWI. 

Applicants don't realize it is VAWA until the interview. I'm assuming the major barrier to any one of the applicants adjusting is EWI because most appear to have at least one USC child. 

Love the phrase @Timona used "selling chicken milk".

If his children are US citizens over 21, then they can petition their parents regardless how they came in, with or without documents. The US Catholic Charities has helped thousands upon thousands of US citizen children bring their parents to legal status in the US.  And Catholic Charities does it for free, all they have to pay is their Immigration fees.

They can, but there is no mention of anyone in this case who can file a waiver, seems both Mother and Father are undocumented.
