Critique removal of conditions cover letter please? Any suggestions or improvements welcome.

Dear USCIS Examiner,

Enclosed, please find a JOINT I-751 petition for the Removal of Conditions on the Permanent Resident status for Wifename Lastname.

This permanent resident entered the US on a K-1 visa on 04/XX/2021, married the U.S. citizen on 04/XX/2021, and was awarded Conditional Permanent Residence on 10/XX/2021that expires on 10/XX/2023

Note: A 10 year card was given erroneously despite being married for less than two years at the time of granting permanent residence. (Attached is a 1-90 receipt showing an application

to fix the erroneous card was submitting on XX/XX/2021, as of XX/XX/2023 it is still being

actively reviewed).

Included with this petition are documents that show the merging of the personal and financial lives of Husbandname and Wifename Lastname since marriage on XX/XX/XXXX and their life as a happily married couple, continuously residing at one address at 123 S Street, City, State

1. Form G-1145, E-Notification of Application/Petition Acceptance for 1751 Form 2. Check for $680 (including 1751 filing fee and $85 biometric service fee) 3. Form I-751, Petition to Remove Conditions On Residence filled and signed by Wifename and Husbandname Lastname

4. Copy of Permanent Resident Card: Front and Back (ERRONEOUSLY ISSUED 10 YEAR

1. IRS tax transcripts for 2021 and 2022 showing jointly filed federal taxes for Husbandname and Wifename Lastname, along with a copy of a refund check to

from the state  made out to Husbandname and Wifename Lastname 2. Bank statements from May of 2021 to May of 2023 for the joint checking account of Husbandname and Wifename Lastname, along with a letter from the bank branch manager.

3. House deed showing joint ownership of the property at 123 S. Street St, City, State 4. Documents showing Wifename Lastname as sole beneficiary for Husbandname

Lastname's IRA accounts.

5. Durable Power of Attorney documents showing Wifename and Husbandname can act on each other's behalf in legal and medical matters

6. Documents showing Wifename covered by Husbandname's employer provided health insurance plan 1095-b for 2021 and 2022 showing coverage, hospital bill

showing health insurance being utilized 7. Permission to release health care information filed with Ascension Borgess

Exhibit D Evidence of shared experiences:

1. Amtrak tickets showing travel together between City and City on XX/XX/XXXX

2. Round-trip plane tickets showing travel together between City and City

3. Boarding passes showing travel together from City to City. 4. Tickets for places and attractions visited together in City 5. Amtrak tickets showing travel together between City and City on XX/XX/XXXX

6. Photos showing travel and experiences together as various places like. A list of locations goes here

Looks good, other than the formatting.  I suggest you keep collecting evidence up until the time of your interview or approval notice.  Good Luck!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You did a fabulous job. 

Replace the long references throughout from the long husband/wife phrases  with “ as evidence of shared residence “ and “ as evidence of joint ownership “ .

Bold or underline  USCIS Error in ref to I-90 and initial I-551 card

 

If you own cars, add registration/insurance..cell phone/ internet plan/ and a couple of family photos.

 

You want to try and keep description of exhibits short and approx one sentence …even without edits you did well on clarity and solid evidence 

 

Add “ Insist on filing “ on your mailing envelope, to avoid someone rejecting in error after quick glance at 10 card/system status.

The mailing address already says:

"Attn: I-751"

It's a cover letter, don't overthink it. 

It gets checked to see if it's late, then scanned with the rest and little, if any, attention paid to it.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I understand, I just don't want them to reject it when they see the erroneous 10 year card thinking ROC is not needed.

Once you make it past the mailroom, you are home free and just need to wait for a review. 

The mailing envelope “ Attn Mailroom Supervisor INSIST ON FILING “ will get you in…usually written w a sharpie in big letters

Why wouldn't it make it to the review as a standard practice? When we did AOS application, only put ATTN : "Adjustment of status application " and it worked fine. Is it because of the pending I90?

Just do it as you wish..you asked for insights , I offered some…certainly not meant for you to find a new thing to worry about.

Mailroom does not read your lovely cover letter..they just do checklist review and scan…

I think you’re missing the point. 
 

@Family is suggesting that you write on the envelope INSIST ON FILING just so that they understand that they sent you a 10 year green card by mistake. You don’t want this package to be rejected, so by writing INSIST ON FILING its like you’re telling them “hey, I know I already have a 10 year green card, but trust me, I know it was your mistake, so please accept this package”
