Bringing spouse and son to the US

Hello:

 

So a friend of mine applied for his wife and son's I130 last year (around March).

 

Uscis approved the wife's I130 and sent it to NVC

However the son's I130 was closed and sent to department of state. 

 

My friend married before he became a US citizen and his son was born before he became a citizen too. So we were under the impression that the son needs an I130 with his mother. 

 

Why would USCIS send the application to the department of state and what is his next step?

But wouldn't the child has to be admitted to the US as a permanent resident for N600 to take effect? 

 

Why would uscis forward his application to the state department instead of nvc with his mother's?

NVC is within the department of state. From what I’m understanding, it has been sent to NVC, maybe the wording is off and they said “dept of state” instead. Your friend should contact the NVC and inquire.
 

His son does need his own I-130, as he was not a USC when the child was born.

NVC is part of the State Department.  Regardless, I am not completely familiar with the N600 process, maybe @Mike E will weigh in.  It also would not be a bad idea for your friend to join VJ themselves as often 2nd hand info is difficult to decipher.  I do believe the child will have to be legally admitted to the US to obtain citizenship through the father.

Son is not a U.S. citizen 

 

N-600 is not appropriate regardless because son is not in the U.S.  

 

1. When USCIS denied I-130, what was the actual I-797 denial letter.

 

2. Whose names are listed as parents on the son’s birth certificate?

 

3. Was the son born in wed lock?

1- Case wasn't denies. It was closed and forwarded to department of state. 

2- both parents

3- both parents were married at the time of birth

Does not make any sense. If a case is closed it is denied or approved.

The message very clearly says "we sent your case to the Department of State for visa processing"  A missing e-mail would be very different from a denial.
