F2A petitioner becomes a citizen before visa appointment

I will assume here a Notario prepared their case and subsequent Natz. 

English was good enough to pass citizenship test ..so no they did NOT do everything ByThe Book.

 

They can however help themselves by correcting the course . 
 

Being Cuban , they do have an advantage and can apply for parole for child.

Do that straight away and hope they are lucky

It is too late anyway, I was unaware the petitioner may have attained citizenship and checked the  LPR box, and it has been sent already.

Then you've got an even bigger issue here....

Unfair, how?  Visa category rules are the same for everyone, regardless of where they are from.  It wouldn't be fair if a USC petitioner from Cuba could bring over derivatives, but those from other countries could not.

Begs the question why they did not apply for Parole when it came out? That would be the obvious route.

I think they were at consulate stage when parole came out, I guess they thought it best to just continue the proper legal path. Wrong!

So is humanitarian parole more difficult now, with a longer wait?

Looks like petitioner forgot to tell beneficiaries, and let them just proceed and pay fees that could have gone to a new I-130. Not much to do now except attend interview, hope for a miracle

Cuban parole only came about Feb , 2023..and it actually part of a  Legal Pathway policy change. 
 

Advise your friend to participate in this post..so he understands what steps to take..

It has changed significantly but still free to play.

.Thanks, but he thinks he would rather accept advice from an attorney on this.

They have been very quiet on the number of applicants, half of the allocation goes to a lottery and the rest on first in first out.

 

They also banned duplicate entries presumably because of the lottery aspect.

Actually your english doesn't need to be very good to pass the citizenship test! Studying the questions and answers will do it though.

As long as he makes a timely withdrawal I do not see an issue, they have had not benefits.
