RFE for birth certificate

Got an rfe for birth certificate for form I-485 which I definitely Included 3 times in total ( one for each form). Haven’t received the actual letter in the mail yet but saw the rfe was send out 2 days ago in my online account. Can I submit my answer online ( I’m seeing the option in my account there) or do I have to wait for the actual letter ? Do I just submit the same certificate again? Any ideas why I got an rfe ? The birth certificate was in English and definitely the correct one.

I do not know about the online submission because that was not an option for us back in 2019.  However, we got the same issue.  My husband's BC was included with AOS/EAD/AP applications.  For whatever reason, we got an RFE for the AOS regarding BC when I know it was there, had been properly translated, etc.  So, we just submitted the same as our original submission.  In our submission, we included a cover letter, a copy of the RFE letter, and the BC again.  I wish I could tell you why you got the RFE.  In our case, we literally sent the same thing, sometimes it could just be they misplace it, they miss it in between the paperwork, etc.

May 2019 - K1 interview scheduled and packet sent to embassy

June 2019 - K1 interview, approved, and moved to USA

August 2019 - Married

September 2019 - AOS/EAD/AP filed

October 2019 - Biometrics Appointment

January 2020 - AOS RFE for birth certificate received and sent back

February 2020 - EAD/AP approved and got the card

October 2020 - EAD/AP renewal filed

November 2020 - EAD/AP renewal approved and got the card - AOS interview date issued

December 2020 - AOS interview, approved, and GC received

September 2022 - ROC filed
June 2024 - Biometrics Reused
July 2024 - Approved (NO INTERVIEW) and GC received.

Comply with the instructions in the letter. 

The I-485, I-130, and I-765 are all separate entities.  Sometimes USCIS loses things.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It's really, really hard to give you an accurate answer without knowing your country of birth. But look at the Visa reciprocity table and see if the birth certificate you are sending is what THEY need based on that table. 

Translate it, have the translation notarized, and submit.

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Thank u. The country is Germany and the certificate is a specific international one with English translations already on there. I will check out the table

Thank you for this input. What exactly did you put on the cover letter? I’m pretty sure what I have is the only right thing to submit cause it’s an international BC with 3 different languages on there (one of them English) so it’s definitely good for international and it’s an official one from my home country Germany. So I think they really must have lost it or something

Hint: just because you think it’s “good for international”, it does not mean it is good for USCIS. They are rather specific as to the type and format of the document, so use the visa reciprocity table. This is exactly what they are looking for (as you can see it says nothing about three languages)

Issuing Authority: Local registrar's office (Standesamt) where the birth occurred.

NOTE: For former East Germany, this applies only to those civil status cases that occurred after October 2, 1990. For events occurring prior to this date, documents from this part of Germany are issued by the district office where the event occurred.

Special Seal(s) / Color / Format: Local registrar’s office official seal, signed by the recording official/ white paper/ different formats depending on issuance date

Issuing Authority Personnel Title: Standesbeamter (recording official)

Registration Criteria: To be checked with issuing authority

Procedure for Obtaining: The requested certificates are usually mailed out by the registrar's office with the fees being collected on delivery. The applicant may enclose a self-addressed and stamped return envelope and use German postage stamps or a collection-only check for payment.

Certified Copies Available: Yes, “beglaubigte Abschrift aus dem Geburtsregister“

Alternate Documents: Auszug aus dem Geburtseintrag (extract from birth registration). This document is also issued by the German registration office (Standesamt) where the birth was registered.

There is no such thing as an “international” birth certificate. You were born in Germany, therefore, it is a German bc with certain features

Based on what I've read Germany has some international version of certified copy of birth certificate, e.g. a version that comes with English text.

 

However, my gut is telling me USCIS wants a copy of original certificate in German, translated to English.

This is exactl what I got. It’s literally called „international BC“ … I get you though. I’ll go the safe way and just have the regular one translated into English. Thank you

Yes there is. The headline is literally „international BC“ . Germany offers that.

Don’t do that. It is issued in both the native language and English..and no translation required.

It does happen that a page or two goes missing at initial processing …so if that is the only requested doc ,then provide it again.

Yes that’s exactly what I initially thought. Cause it already comes in English and German so I thought ok perfect 😂 hummm. However I provided the same for my child, and no rfe on that one so far… maybe the really did lose mine .
