Hello,

Hoping for guidance. I submitted my n400 application in March 2021. I was invited to show up for my interview scheduled for Feb 2022. When I showed up, the officer mentioned my a-file was not at field office so a reschedule letter will be sent to me once a-file shows up. I have called USCIS customer service line and they show a-file has been at office since Aug 2022. My case is now outside processing time and I have filed online request but it's not been successful. I contacted my senator Aug 2022 and they told my senator that my interview is in queue to be scheduled. It has been over two years since I submitted my n400 application, over one year since I was told my interview could not proceed because a-file was not at the office at the time, over 9 months since they told my senator the interview was in queue. What do I do next to get my n400 interview scheduled? I have filed multiple online request since my case is now outside processing time but nothing has been helpful. I feel stuck

Contact your congressman again.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Federal Court?, you are well beyond 120 days

I have not tried this. Should one go through ombudsman before lawsuit?

I suppose I will need a lawyer for this. Is it advisable to do this before trying ombudsman. Someone had recommended that on the thread

They just tell me the same information that USCIS tells them which is my application is in interview queue. They then tell me that if I don't hear back, I should contact them in 90 days which I have done twice now.

I have seen the Federal Court mentioned but do not know how it is done, well I can guess but that does not help you.

The other options may have an impact, or may not. Depends on how important this is.

Personally, I would try ombudsman first. You could work on preparing the lawsuit in the meantime.

OP can file a Complaint for An Action Under 8 U.S. Code, Section 1447(b), however, more information is needed to determine right course of action. Unlike WOM, a complaint under Section 1447 (b) proven to be very useful and can be managed Pro Se.

True ..they don’t deal with delay or missed processing time promises.

Remember the recent class action for delayed N-400 ..and the missing files.

correct. either ways only courts can resolve OP's issue. Not senator and not any ombudsman.

Thank you. Very helpful. Do you recommend getting lawyer or filing oneself?
