Hello, me and my fiance so the k1 visa.. we almost ready for the interview and I saw on the DS160 form the question if i even been arrested... Well when i was 21 (like more then 10 years ago) i been arrested for driving on the moped while i drank alcohol..... I needed to pay 300 euros for that. Now i am like freaking out about this that this is gonna be a reason our visa is gonna get denied. I didn't fill it in yet and I'm definitely not planning to lie... I saw that there will be no records of it anymore but I'm pretty sure they probably gonna find out anyway. Is there someone with a similar situation? What is the best way to go about this?

Look at Visa Reciprocity got your country and follow instructions on what type of judiciary/ court records you need and what sources are acceptable.

Worst case scenario , a past DUI will mean a one year drug ban ( no matter how long ago the incident)

A one year drug ban??? I mean i had a couple beers and drove a moped.. i really hope that doesn't happen....

The doctor will determine that

The rules are set by CDC .. you can do a bit of research.

I have not kept up, so hopefully some with more recent experience will respond. Most recent thread I recall was within 12 months

The CDC has issued new guidance on alcohol abuse to panel physicians.  Gone is any reference to “1 DUI in the past five years or 2 DUIs in the past 10 years.”  Instead, the CDC guidance now refers physicians to the DSM-5 (Diagnostic and Statistical Manual of Mental Disorders, 5th Edition). The CDC guidelines are here:  https://www.cdc.gov/immigrantrefugeehealth/panel-physicians/mental-health.html

Here is a recent London Consulate decision on a 16 year old DUI.

Just go about getting your records and you will face whatever comes your way..

  • 1 month later...

For everybody who goes thru the same. I went to my medical and got no questions about arrest & drinking. I was honest on my ds160 form about what I did and at the interview she did wanna see the court records... She asked if it only happened once and ask if it really wouldnt happen anymore... And if a accident happened or someone got hurt. But that wasn't the case with me so! I don't know if that would change the outcome. That was about it. I got approved at my interview! I'm happy I was honest. I also always planned to be honest.
