Hello,

 

My father had applied for my daughter in 2012 , he is a US citizen. We received the approval letter in 2015 but nothing after that. 

 

He was diagnosed with bladder cancer last month and is going through chemo. We want to bring my sister (his daughter) to the United States asap. I had sent a message to nvc requesting the status but they said they can't do anything until they get the visa number but we don't have the visa number I tried calling USCIS multiple times but no luck. Can someone please help what should we do to expedite this request? Also, my niece is turning 21 next year. 

 

Please help!

There is such thing as a grand parent petitioning a grand child.

But he had already applied for them back in 2012 I don't see the point of petitioning again for grandkids? Also he has cancer which is why I'm trying to find a way to bring them here asap

He could not.

I an sorry, but the law is clear: until a visa number is available no visa can be issued.

 

Apply for a B-2 visa so she can visit him.

For your daughter? Do you mean his daughter? This is confusing,

Expedites are not possible if there is no visa number available. You can only expedite once the visa number becomes available. There’s no way around this

It seems he petitioned his daughter, your sister.  Your nephews and nieces are derivatives of your sister.  

 

Until your sister's PD is current, there is no visa available for her to proceed with her immigration process.  Medical emergencies, death, etc. cannot override this requirement.

Do you know how can they get the visa number? I tried messaging nvc but I did not get any response

Yes his daughter and my sister sorry about that but how do we get their visa number? It's been so long we have not received any update

This is frustrating because they are not giving us any kinda update on visa number 😕

Which country are you from? And did you father petition as a US CITIZEN or LPR?

Google "Visa Bulletin".

 

It is updated by the US Department of State.

US, they live in India and the petition was filed as US citizen

Is your sister married or not?

 

She was married when he had applied for her and her family in 2012.

She was married when he had applied for her and her family in 2012. 

Check the visa bulletin: 

if your sister is married she should look at F3 category under INDIA. Currently they are processing cases from 2008.
