Hey guys, I'm very worried about something and if you could just read and give me your honest opinion on this, I'd appreciate! I know it's a long post, but I need help.

I've posted somewhere on VJ before about something that happened to Dave a few months ago but I can't find it. So I'll explain it to you again.

When he came to Brazil, somethings that we didn't expect happen and that caused him to get depressed and extremely anxious too. We then decided he'd start going to therapy and one of the doctors prescribed a medication called Rohypnol, which is a sleeping pill stronger than Valium (he REALLY needed something to help him sleep or he'd get like 1 hour of sleep every night).

After a few months, we decided it was time for him to go home so that we could start the process and he'd continue his treatment with his own doctor in the US. The doctor here in Brazil wrote a prscription allowing him to take a few pills on the plane just in case he needed them (he was SO scared of the flight back home).

The flight went great, he didn't need the pills at all..... when he got home he probably put the pills (there were 4) in the glove compartment and we just forgot he even had them.

Okay, now it gets ugly! Driving home from work one night, he drove by a casino and got stoped by a police officer that wanted to warn him that one of his lights wasn't working. The officer asked if he could look inside his car and all, Dave said yes. And the officer found those 4 pills in the glove compartment!! Oh man I feel so guilty because I should've remembered he still had them!!!! He was taken to jail, spent the night there.... by that time his family and I were going crazy trying to find him.... :crying: Anyway, his dad went there but had to wait until 2pm the next day to get him out. This happened in January. It was clasified as a felony (I forgot what class.... I'll ask him later).

Now he's going to court next friday..... I'm so scared and feel so hopeless!! He has a good lawyer, he has a prescription from the doctor here in Brazil. But I can't help but feel scared!! I don't know what my life is going to be like if anything happens to him! Next friday I'm going to say bye when he goes to court but I won't know when I'm gonna talk to him again. This has to be a nightmare :(

So pray for us people! ;)

Any advice, opinion or if any of you went through something like this or know someone who has, your post will be appreciated.

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!

I dont get it, if they were precribed pills why did he go to jail?? Ive brought medicine back from Romania, even showed them at customs and nothing happened. If it is prescription medicine it cant be a felony.

found that online. could explain the felony now. have you contacted a lawyer or he, his family????? he can get this thrown out of court IM SURE.

Rohypnol is marketed by Hoffman-La Roche Inc., and is legally sold in Latin America and Europe as a short-term treatment for insomnia, and as a preanesthetic medication. One of the significant effects of the drug is anterograde amnesia, a factor that strongly contributed to its inclusion in the Drug-Induced Rape Prevention and Punishment Act of 1996. Anterograde amnesia is a condition in which events that occurred while under the influence of the drug are forgotten.

Rohypnol is available as a .5-milligram and 1-milligram oblong tablet, as well as a 1-milligram per milliliter injectable solution. Hoffman-La Roche phased out the 2-milligram dose tablet from 1996 to 1997, and is currently phasing out the round, white 1-milligram tablet. The licit market for the drug is currently supplied with a 1-milligram dose in an olive green, oblong tablet, imprinted with the number 542. The new tablet includes a dye that, according to Hoffman-La Roche, will be visible if it is slipped into a drink. Reports indicate that Rohypnol is often sold for between $2 and $5 per dosage unit, although it may sell for from $10 to $30 per dosage unit.

Get him to get a GOOD lawyer, because yes this is a felony in the US, i dont think its perscribed here, and if it is, he needs to get his doctor to help him as well.

They're not legal in the US. That's the reason why he needed a prescription to even have it on the plane with him.

His lawyer said there's no way he's gonna go to jail or anything, and that the officer had to tell him that Dave could choose to not let him search the car because he hadn't done anything wrong (except that one of his lights wasn't working). Dave did tell the cop he had a prescription for them at home but the cop said he would have to present it when he went to court.

This just sucks!

MrsK... I have no clue as to the process and what may happen... but, I feel sure that if he has a good lawyer... AND the prescription from the doctor there in brazil - and tells the judge the truth about what happened, that the judge will take all of that into consideration. Of course, that is just my opinion. Please know that I am praying for you both... and wishing you all the best! *hugs* I know that this has got to be a stressful time for you... until the MOMENT OF TRUTH... and you actually find out what happens from the court proceedings. Keep us posted. We care about what happens to ya!

US is much more strict about drugs that are prescribed, but I think he can prove that it was a doc´s prescription, and he wasn´t smuggling illegal drugs to US.

Is it possible to have the Dr there where you are to fax a statement that he did indeed perscribe these pills to him for the reason he did, ALONG with his credidations to prove he is INDEED a doctor and knows what hes talking about? it could help in court alot i believe. I mean seriously though, a cop finds something like that on a person or in possesion and he can say anything for why hes using it, but it is indeed a date rape drug and illegal here, so all the help you can give him would be wonderful.

im not saying he will deffinatly go to jail, or get into big trouble, im just trying to give advice in a way to get him EXTRA support when he appears in court.

It is not prescribed there..... that's why his lawyer asked the doctor here to send his medical record and to state the reason why he had the drug with him in the US.

This all happened in January so we had some time to come up with everything we need. He does have a good lawyer already, since the first day. I'm pretty sure nothing bad is gonna happen. But this is SO stressful, I think I'm the one who needs suport rigth now.... lol. I can't tell him how scared I am or it'll just freak him out. :P That's the biggest reason why I posted this.

Well with everything your saying, the whole thing should get thrown out of court and he should walk away free. so calm down girl :) take a big deep breath. Its all going to be ok :)

Although it is a prescription, some meds are not to be taken while operating a vehicle. They were in his car, he had a script for them and he was not taking them, so hopefully everything will be ok. I'm a nurse and I see quite a few people that get medications from other countries while they are traveling abroad. Hopefully his attorney knows what he is doing and this issue will be settled quickly. Best of luck! :thumbs:
