A few questions (K1 VISA)

Hello all!

 

This will be my first post on this forum. I am currently working on submitting a K1 VISA for my fiancée. We have meet in person for 3 weeks after speaking for 6 months. Her values and I are aligned and I'm very eager and thankful to be marrying her. Her and her family are also terribly excited. Now on to the questions for the community

1) How large should I make the section for proof of relationship (We have been texting every day for 6 months phone calls ect). Is more better I honestly think I could provide pages upon pages.

2) Is it better to attach documents before receiving an RFO this pertains to two examples: 

2A: We meet on Filipino cupid which is technically not a marriage broker site (I could provide documentation of this from the website if you all think its useful)

2B: I have been moved out and not in a relationship with my x, however due to discussions about custody and life events my divorce was just recently finalized. (I have documentation on the divorce stating we have not been together since 2019). Should I write a letter of explanation have her sign me sign (My partner was aware of this when we started texting and calling). 

 

3) I am in the US Army reserves and childcare for my daughter is becoming an issue, could this potentially qualify me for expideted processing? If so who would i talk too?

 

I know its a lot but i really would appreciate any help or comments. My plan is to file June 10th after completing all the documents and double checking them. Currently i do not have money for a lawyer or a visa service so I'm doing the best I can.

They do say Manilla hands out K1s like Candy but in your situation with money issues a CR1 would seem much better.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Timothy, welcome to the forum.

Terminology is important.  You plan to submit an I-129F petition, which, when approved, would give your fiancée the right to apply for a K-1 visa.

 

1)  If your fiancée would be interviewing at the U.S. embassy in Manila, it's been described as a softball embassy that hands out K-1 visas like candy.  (In many consulates, a single 3-week visit and 6-month acquaintanceship would raise red flags.) Include basic (not overwhelming in volume) evidence of a bona fide relationship, such as airline boarding passes, some photos together, shared receipts, etc.  Concentrate more on the USCIS requirements (petition phase):  proof that you're both free to marry, proof that you've met in person within the past 2 years, and a letter from each of you in which you state your intent to marry within 90 days of her arrival in the U.S. with use of the K-1 visa.

 

2A)  It makes sense to include Filipino Cupid's verification that they're not a marriage broker.  USCIS has insisted on this in the past.

 

2B)  Along with a divorce certificate or other verification of divorce, include the information that you describe.  If you met your fiancée before your divorce was final, it might be problematic.

 

3)  My understanding is that only active military with deployment orders stand a chance of expediting some steps in the immigration process.  Others here can comment with more authority.

Thank you for the reply. 2B did concern me but I'm not sure how to correct it besides writing a letter that the divorce was in process (had to go through the process twice each time has a mandatory waiting period). I'm not concerned about what happened everyone knew what was going on I was not engaged in anything I would consider immoral but I digress and I understand how someone could look at that with a raised eyebrow or 2.

Will your financial concerns no longer be a problem in 12+ months?

Be aware 

1.) Once your partner comes to the US you will have to marry and they she needs to adjust status. 

2.)The cost of adjustment is about to increase (over $2000).

3.) She will not be able to work until she receives her employment authorizations.

4.) Depending on the state you live in- she won't be able to drive until she receives her employment authorization. 

~Currently work authorization is taking +/-8 months but the time could increase or decrease (we have some members waiting on permission to work for over a year). 

 

Do not only think of the immediate short term issues you are facing. With immigration to the US, you have to plan for the next 24-48 months.

Speaking as another Filipina who married a US citizen, I am 99% sure that her family is expecting her to financially support them after her arrival in the US. This is another reality of marrying into a Filipino family.

The financial strain is due to a childcare issue when she arrives I am able to take higher paying jobs and work additional overtime without paying for babysitters. Right now i work as a nurse so its the ability to work that is becoming the issue. The jobs are there the raises are there the OT is there. Me and her have talked about supporting her family and i have no issues or concerns on that front.

Well not sure I can make this make sense but does make me wonder if you are aware of the sort of timeline you are looking at.

Its pretty simple really. I am expecting a gap of 12-20 months between when I file the 192F before she arrives. I am currently working full time as a nurse, I support myself and provide her family aid. With a 12-20 month lead time I will be able to accumulate all of the funds I need to get her here and file an adjustment of status. My issue with not rolling in the $$$ is due to the fact I have 50/50 custody and can only work certain days of the week due to childcare issues. Example I work SUN MON TUES (16HR) along with additional shifts as needed. I have been offered positions with a 10-15$ HR increase, and sign on bonuses of up to 15,000 USD. I cannot accept them at this point because i am locked into working SUN MON TUES (and additional days as babysitters are available). With her arrival my flexibility of working other days increases so my potential for $$$ increases.....

A low budget wedding is less expensive than the high cost to AOS which is suppose to go from $1225 to $2820 after the US marriage

Very much doubt you’d be granted an expedite to bring over a fiancé to provide childcare for you.

It has been a long time since 12 months was the norm, 20 months or so I can see.

 

So you are sending money now? What were they doing before you hit the scene?
