Dear All, My Petition send back to USCIS for further verification after Consular Mumbai interview. Myself & Petitioner both waiting any email or connect from USCIS last 4 months. I have emailed last week to Mumbai consulate & Visa Travel doc for any update. Also it is 180 days over after RFQ doc submission. They have replied to connect with USCIS. While i try to connect USCIS by phone, it is asking Case number to proceed ( all correspondence with Consulate is mentioned only DS160 application number). Please suggest how to find USCIS case number with regards to my Petition. Please also let me know how much time will take to close from USCIS to send back the petition to consulate to proceed.

Is this a K1? If so they will just let it die.

Usually there is no letter (email) sent to say the issues the CO had for a K1  denial

you, the bene, know how the interview went and what the CO concentrated on in the interview to make them suspect relationship was real

to correct this ,  the best direction is to marry ,  spent as much quality time together as possible before the CR1 interview to convince CO that the marriage is bona fida

Your case number would be on your I-797, usually starts with 3 letters i.e. WACxxxxxxxxx

But what is the petition for, which visa?

Receipt number and case number are two different things. USCIS hands out receipt numbers, NVC case numbers.

A receipt number starts with three letters of the USCIS service center that has handles your petition. You are absolutely correct that the receipt number can be found on the i-797 document. That's what OP needs if he wants to get in contact with USCIS about his petition.

A case number also starts with three letters but they are the letters of the consulate/city where your interview will be conducted. For Sweden for instance, that's STK for Stockholm.

  • 3 weeks later...

Dear All,

Trust all are safe and fine.
I have posted some queries regarding my existing H1B petition. Further some updates happened and i would like to get your suggestion.
Back ground:
I have got H1B petition with one of the consulting company and got approved from USCIS ( 2022). I went to interview with consulate and RFQ to submit,
after two months petition send back to USCIS for Background check and possible revocation. It was due to Petitioner & end client name lot same and in same building,as well some document clarification needed from Petitioner. I have informed Petitioner to check with USCIS and last 4 months they said not heard from USCIS.
I have directly contacted USCIS and they have informed Petitioner or Attorney only they can give information. Same i have informed to Petitioner, which
petitioner response is they cant help anymore and they asked me i can transfer H1B petition through any eligible employer ( i think they afraid to contact USCIS for further
probe in the operation). If they have received or contacted for clarification , which they have not informed me asap, if They did not submit clear reply my Petition might be
cancelled in the future ( assume).

Another thing is that current 2023 H1B lottery also mine got selected through my current company ( Indian IT services Organization ( one of the top 5) and i have got client letter from big US
MNC company ( as i am working & managing client offshore activities). Currently Attorney going to file Petition in USCIS.

I have query regarding existing Petition can be transferred ( LCA & H1B transfer) ?
2023 H1B petition filing , USCIS might ask or inform my current employer attorney about existing Petition, which scenario what is the option i have?

Please help me to take decision and suggest your kind understanding. It will be great help. Thanks for your valuable time.

I have read elsewhere that this year they are cracking down on multiple applicants/Desi companies, now I do not know if you fall into this category.

Here is one example.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Hi Boiler,

Thanks for the reply and valuable time. As earlier I have mentioned i am legit to work ( i have 24+) years experience in the domain and already worked outside country 10+ years.

Come to this I am not filing H1B same year, as last year petition struck and This year i was applying through one of the Big IT company with Client letter provided by US client Program Manager ( working with him 7 years).

So last year petition can be cancelled? I read it requires Petitioner has to email to USCIS,I don't know they will do it. They are asking me to H1B transfer.

i have responded by other legitimate member that each cases different and USCIS will not give info to current Company Attorney.
