I 134a Update

I noticed a recent update on the instructions.

For those familiar with the H1b and the DV they have added elements.

First duplicate entries will mean disqualification.

Second and more significantly they are splitting how they process applications. Half with be on a first in and first out basis the other half on a lottery.

So 30,000 a month so let's say 1,000 every day.

500 will be selected randomly for processing

500 will be selected on the date filed.

I assume this is because they want to give people the illusion of a chance and keep Mexico happy.

I have not seen any mention of how many people have applied, there are only 360,000 every year and seems likely there have been millions of applications.

This does not seem to apply to Ukraine which as far as I can see remains uncapped.

What I cannot work out is what happens where families are involved.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

DV lottery allows for spouse and children as derivates

page 11 #12

12.   May my spouse and I each submit a separate entry? Yes, each spouse may each submit one entry if each meets the eligibility requirements.  If either spouse is selected, the other is entitled to apply as a derivative dependent.

Failure to list your eligible spouse or, listing someone who is not your spouse, will make you ineligible as the DV principal applicant and your spouse and children ineligible as DV derivative applicants

I did not see any mention of allowing derivatives, now that would make sense. This is all I know.

ALERT: The U.S. Department of Homeland Security updated the processing for all pending Forms I-134A filed under the processes for Cubans, Haitians, Nicaraguans, and Venezuelans. On a daily basis, approximately half of applications will be selected for review at random by USCIS. The other half will continue to be reviewed in chronological order based on their filing date, using a first in, first out methodology. Duplicate Form I-134A filings for the same beneficiary will be rejected.

These changes will give all individuals with pending Forms I-134A an opportunity to be selected each day, while also guaranteeing that those who have been waiting the longest will be processed.
