Second Interview after denied (split)

If after an  interview your spouse was denied a visa,  and after a month you email the consulate and request for another follow up interview to reconsider their decision saying you have a new evidence and the immigration schedule another interview, is it a positive thing? Because I know if you are denied a visa your application is returned back to the nvc as said in their email.

Does not happen like this. What was the denial reason? Is this a CR1/IR1 or K1?

C21 for spouse, her passport has been held for 2months now even before I requested another follow up interview.

That’s not how it works.   If they decide to do a second interview, they’ll notify the visa applicant.   You can’t just decide you want one.

I mean, I requested a follow up interview because it’s been over a month and her passport is not return to her. So I wrote them requesting for a follow up interview and they accepted and sent me an interview date.

Yaounde is in Cameroon not Nigeria... are you a naturalized USC originally from Nigeria petitioning a spouse from Cameroon? 

Or are you an LPR from Nigeria petitioning a spouse... you first posted in the Permanent Residents forum but have since posted in the CR1/IR1 forum... 

How did you obtain your green card/citizenship? 

I would also like to add... it might not have been smart to request another interview... there is a chance the embassy was just going through background checks and they would have been happy to issue the visa to your spouse without her having to return... it has happened to other applicants in the past...

I’m a Nigerian my spouse is in Cameroon and we got married in Nigeria but I live in the USA, permanent residence. My spouse was denied a visa at her first interview so it’s not like she was going through background checks or anything, they denied her the visa.

What is your timeline? How did you get your green card was it through marriage? 

Was the marriage denied due to bonafides?

I came to the USA as a refugee, she was denied because they think the marriage is not back by law because non of us resident in Cameroon but since I can’t go back to Nigeria to sign we did it in Cameroon

Ah… sounds like you have a battle.. hopefully your evidence the marriage is legitimate is strong and your wife taking the material and explaining it is the best course as opposed to just submitting the documents

Yes I think so and her passport has been with them for almost 2 months now since she was denied a visa. I’m even surprised they gave her a second consulate interview after requesting.
