Filing 90 days rule N400

You can apply online, even if you are using the 90-days window.  However, please keep in mind that the computers with USCIS sometimes are in Pacific Time.  Thus, a lot of people apply a few days into the 90-day window just to be sure.  In other words, my husband's window for N400 will open on 09/09/2023.  If we were to apply, we would probably apply around 09/11/2023 at the earliest just to make sure all the computers and systems as past any hours and the date of 09/09/2023.  Otherwise, we could run the risk of getting denied because of submitting it too early (according to the computer).  I hope that makes sense.

May 2019 - K1 interview scheduled and packet sent to embassy

June 2019 - K1 interview, approved, and moved to USA

August 2019 - Married

September 2019 - AOS/EAD/AP filed

October 2019 - Biometrics Appointment

January 2020 - AOS RFE for birth certificate received and sent back

February 2020 - EAD/AP approved and got the card

October 2020 - EAD/AP renewal filed

November 2020 - EAD/AP renewal approved and got the card - AOS interview date issued

December 2020 - AOS interview, approved, and GC received

September 2022 - ROC filed
June 2024 - Biometrics Reused
July 2024 - Approved (NO INTERVIEW) and GC received.

Also be aware that you can apply early, but you cannot take the oath early.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Are you sure? I thought I saw someone posting they had the oath ceremony before the 3 yrar anniversary.

That is a practical non issue..since it assumes the N-400 would be processed , interview completed and oath scheduled in less than 90 days from the date of filing…they are not that fast.

 

The only issue with filing early is the rare chance the couple has not lived under same roof/ marital union for 3 years full…so it’s always safer to apply on the 3rd anniversary of the LPR resident since date.

USCIS makes errors.

 

If even the interview is scheduled less than 3 years after the “resident since” date, you should reschedule.

It may have been just the interview. Sorry, don't have a link, but I reacted to it being within the 90 day window.
