The Manhattan district attorney, Alvin Bragg, announced on Thursday that Penny would be arraigned on a second-degree manslaughter charge and he surrendered to police on Friday. He appeared in court shortly thereafter and was released on $100,000 bail.

The family of Jordan Neely, who died in a subway chokehold incident, is calling for the prosecution of the two men who helped the ex-Marine hold Neely down. Christopher Neely, Jordan’s uncle, stated that Daniel Penny, the ex-Marine charged with manslaughter, should not be offered a plea deal and should be prosecuted. He also called for the prosecution of the two other men who assisted Penny in holding down his nephew. The family believes that Jordan Neely’s death was a homicide and that Penny should be tried for murder.

Jordan Neely's uncle fled police and then was arrested Monday after being caught with several allegedly stolen credit cards, a day after he spoke out against the ex-Marine accused of placing his nephew in a fatal chokehold, DailyMail.com can exclusively reveal.

Christopher Neely was arrested late Monday night after running away from a police pickpocket team that confronted him at the Port Authority bus terminal in Manhattan, police sources said.

He was wanted for a string of larcenies in Manhattan when he was approached. After police caught up with him, Neely was found with several credit and debit cards bearing other people's names, including at least one that was reportedly stolen during a prior pickpocket. He was also carrying a gravity knife, sources said.

U.S. Marine Corps veteran Daniel Penny was reportedly indicted by a Manhattan grand jury on Wednesday for defending New York City subway passengers from an erratic and threatening homeless man.

 

The incident in question occurred on May 21, when Jordan Neely — who had been arrested 44 times for “criminal conduct” and, at the time, “had an outstanding warrant for felony assault” — began threatening and getting violent with NYC subway passengers. During the episode, Neely allegedly kept repeating the phrases, “I’m going to kill you,” “I’m prepared to go to jail for life,” and “I’m willing to die.”

 

In response, Penny and two of his fellow passengers attempted to restrain Neely, which involved the former placing the latter in a headlock. Neely ultimately died during the encounter, with NYC’s medical examiner ruling the death a homicide.

 

According to sources who spoke with Fox News, Penny is being indicted “on one count each of criminally negligent homicide and second-degree manslaughter.” If convicted of the latter charge, Penny could face five to 15 years in prison.

Bombshell Revelations in Daniel Penny Trial Turn Entire Prosecution on Its Head

 

While the current election is justifiably dominating the news, Daniel Penny's trial for allegedly killing Jordan Neely on a New York City subway has begun, and a new revelation has turned the prosecution on its head.

As RedState reported, Penny initially subdued Neely after the latter began to act erratically, including lunging at and threatening women and children on the train.  Neely would go on to perish and Penny was arrested and charged with manslaughter by infamous Manhattan DA Alvin Bragg.

At the time, the facts of the case were already called into question after a video taken on the scene showed Neely still breathing for a significant period after the altercation.  Further, Penny put Neely in the "recovery position," suggesting he had no intent to cause permanent harm.  At the time, I asked whether Neely was still breathing when first responders arrived.  [...]
