I-864 Employment and Income Questions

Hi everyone. I’m filling out the affidavit of support and I have 3 questions regarding Part 6.

 

1. I was just currently employed, but I have not been paid yet as my start date is in a couple of weeks. Where it ask about my income and position do I input what is on my offer letter and contract even though I haven’t received any money yet? 
 

2. it says “income you are using from any other person who was counted in your household size”

 

would I add my partners income when he is the beneficiary? Technically he is a part of my household, but I’m not sure if I leave his income out or not. 

 

3. Will they be going based off of what I'm earning in the future? Or what I have earned in the past? I didn't work for a couple of years due to having a baby so I didn't have to file taxes, I'm not sure if this will mess things up or not? I'm using a joint sponsor, but I just wanted to ask for caution.

1.  You can submit the offer letter with the contract.  An offer letter by itself is not proof of employment.

 

2.  You can add your spouse's income if his/her work will continue after they immigrate to the US.  If the income is strictly for his/her current employment that he/she has to terminate when they move, you cannot include it.

 

3a.  The decision is based on current income.  What you make now: weekly x 52, or monthly x12, or biweekly x 26, hourly x 2080, etc.

 

3b.  You will need to explain why you were not required to file taxes for the previous 3 years.  State what you wrote here.

1. Your current income is zero because you are not working. If you need to file I-864 now, get a joint sponsor. Otherwise file  I-864 when your job starts.

Who is your partner?  Your spouse?  Your business partner?

Okay, would that mean that I check the unemployed box instead?

 

also should he still bring my employment contract to his interview to show I have income coming soon?

Thank you! My spouses income will stop once he move to the USA, so I'll leave him out.

I would delay filing your I-864 until after you start your new job and have a pay stub in hand for a full pay period.  Then, take the gross pay and multiply it by the number of pay periods is a full year.  X52, 26, 24, or 12 as applicable.  That is your current income.

 

Right now, your income is zero and you are unemployed.  Answer present tense questions in the present tense.  Presently, you are unemployed with no income.

I wish that was an option, I need my husband to go back together to help with the baby. Now I'm a bit worried that I'm in a sticky situation. Is it possible he can be denied because I as the primary sponsor don't have money coming in yet? We already have a joint sponsor as extra precaution.

I didn't notice any mention of a joint sponsor.  Go ahead and file with zero income, then upload and take an updated form before the interview.
