Confusion after interview

Hi,

 

I wonder if anyone experienced this. I had my interview today all went well so I thought. Been told case will be approved but this afternoon status has changed to RFE. Asking about police background check. I had all the paperwork with me and was not asked about it. Also the K1 would have never been approved without them. Also does this mean I need to get a police check now from US as well as I’ve been living here longer than 6 months. I just cannot believe they did not ask about it during the interview.

You do not need a police check for the US they do that themselves

It says:


The police clearance records must be from each placed you lived (whether in United States or outside United States) for the past 5 years. 
 

It sounds like they want me to submit what I had with K1 and police check from CT as I’ve been here close to a year now. London embassy never copied anything. The whole thing just seem ridiculous to me. As K1 would never be approved without the police checks. I had all the documents with me today no CT records as I’ve never heard of this requirement before. Just frustrating she never said anything while we were there.

Sorry it happened to you. I agree it’s rare and not standard practice,  I have heard of them asking for police certificates from the US  in  the AOS process when the fingerprints were unreadable from the biometrics. Hopefully you can send everything asap and get an approval, be sure to post an update

Thanks. I just wish she told me that before we left. I did have biometrics request twice which was surprising. 
Luckily enough the UK police check is valid for 24 months so I will only have to request CT one tomorrow.

Also I’m assuming I can just print the RFE letter I have on my account rather than waiting for the one to come in the mail?

Yep, and you should be able to upload the response on the site as well.

  • Feb 14, 2022 = AOS (I-451, I-131, I765) Filed
  • Feb 20, 2022 = Receipt notice for all three received
  • March 21, 2022 = Biometrics in Dallas, Texas
  • August 9, 2022 = EAD (I-751 approved)
  • August 13, 2022 = EAD and SSN received (SSN applied with EAD)
  • September 6, 2022 = AP (I-131 approved)
  • September 13, 2022 = AP (I-131 receieved) 
  • March 15, 2023 = I-485 approved (interview waived, New SSN received without DHS wording)
  • March 31, 2023 = GC in hand (Total time from NOA-1 to GC in hand 794 days)

You were living in the US for a year while waiting on the K1? What type of visa were you on? Maybe that’s what’s confusing them?

Oh… I didn’t realize this was for AOS not K1 interview… you probably have a name that is similar to someone else convicted of a crime.

This is not standard.  I suggest an FBI report.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

So apparently this happens when they find your fingerprints as unclassified. I managed to find some posts people complaining about the same issue. Apparently I should have been told this during my interview. If it fails verification for some reason you get request for police check for the past 5 years. I guess it is what it is. CT clearance supposed to be 5-10 days. Immigration in US is a very frustrating and long process.

This happened to us in March. We resubmitted the police certificate from our K1 (+translation) and a criminal background check from the county in which we live now. Our county background check was literally just a short request form that we filled out, witnessed by the receptionist at the county jail, and an ink stamp stating that no records were found. We were approved 10 days after they acknowledge receipt. Yes, send certified copies by mail.

@Gauchos that’s reassuring. Congrats on fast approval. It seems like the one for CT can be only done by mail. Cheque still hasn’t cleared they supposed to mail the certificate to me. Not sure how accurate the 5-10 days is. Wait is very frustrating.

Our RFE specified state police clearance records as an alternative so I took the path of least resistance and got the free background check offered by the county. The State of Ohio BCI report seemed like a hassle. The local or county-level report may or may not be an option for you, but I imagine you aren't terribly excited to do more legwork since you've already ordered one from the state.
