I just sent off our I-864 and DS-230 in the same package on Sat so Euro - you and I should be getting done and dusted about the same time. Our paperwork should be on its way to London soon...

I wrote a letter to NVC to change my address. I didn't need any special form, just a letter stating my new address and that I wanna continue CR1.

I also received DS 3032 and bill for AOS today so they are rather fast.

I got a quick question for ya though. with the DS-864, do I send the tax stuff along with it to NVC or do I take it to the interview. In the guides it lists it for both. Or do I need everything in duplicate, once for NVC and once for the consulate?

The I-130 and the Adjustment of Status are wholly seperate processes, correct? If my wife arrives on a K3 she can choose to go back home and continue the I-130 process or stop the I-130 process and do an Adjuistment of Status?

Does all this sound right?

Point of clarification - I feel that this is an area where one should be more careful to use correct terminology.

An approved I-130 is required for adjustment of status just as it is required for an immigrant visa - it is necessary for both, so one does not want to "stop the I-130 process". (In your case, the 'I-130 process' is already over.)

What a K3 who intends to adjust status does want to do is stop, or not start, an immigrant visa application.

what you wanna do if you don't want to proceed the CR1 is not pay the NVC bills or file the forms the send you after they receive your approved petition from CIS but inform them you plan to adjust status.

You speak of I-130 when you talk about the original petition you filed with CIS. The visa type is either CR1 (married less than 2 years) or IR1 (married 2 years and more)

But I am pretty the I-864 forms said that you only need to include them if you have carried out joint tax returns in the past or something like that?

Anyway, we have sent them now.

Euro has your case got to London yet?

Yes my case is in London, infact i just got an email from them telling me they had it and to email them back at the end of this week begining of next week & they should have a date for me!!

The I-864 instruction says, among other things, "A copy of your complete Federal income tax return, as

filed with the Internal Revenue Service ..."

Also, go back to the place where you read about including W2s with joint tax returns and you won't find the word 'only' there.

Going on the basis of "something like that" is an invitation to a problem - the devil is often in the details.

Just to let you know i have got my CR1 interview its April 28th in London, & for informations sake............on the DS-230 i put my us address also did on the I-864 and London have mailed my interview pack to my US address!!

I know we all wondered about this, so hope you all find this information helpful!!

They don't take the K3 out.. they cancel it by stamping it with a cancelled stamp. There are two boxes on the cancelled stamp. One states "with prejudice".. the other "without prejudice".

If the CR-1 visa is denied... the K-3 visa is cancelled.

However, if one was issued the K3, the CR-1 shouldn't be denied as the relationship issue has already been addressed. The only reason I could think a CR-1 visa would be denied after the K3 is if a crime of moral turpitude was committed between the issuance of the K3 and the CR-1 (in which case the alien would be deported anyways) and if the suppoort issue is not addressed.
