sent u a PM. U send ina copy of ur visa in ur passport! Too easy as a CR-1, as u can work right from day 1!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

And then in block 18 for 'Comments', just put 'Relocation for Anticipated Marriage'? Should there be more info in the comments? Should it mention I'm going to the U.S.?

I'm discussing my ROE with my payroll administrator. Just wanting to make sure he gets all the info.

It was mentioned on page 1 of this thread, but I'm just wanting to confirm that this is correct.

Ive been collecting EI and working part time under 30 hours. I want to quit my current part time job cuz the girl i work with can be really unbearable when she is stressed. plus I work for a law office dealing with criminal cases and domestic. i dont really want to work here anymore since i've learned so many F'd up sh!t - things that happens in Law and Order. i have a love and hate relationship with my job but i could live w/o seeing any molestation and other weird stuff.

Would I stop getting my EI if I quit a part time job?

fyi - for those who don't know... you are able to collect EI when you work under 30 hours. EI will pay the difference from your income.

You have to show good cause to quit your job. Generally an annoying coworker or stressful environment (beyond exceptional circumstances) is not sufficient to establish good cause to continue to collect.

True - you'd probably have to jump through hoops to prove mental cruelty and you'd probably have to file something legal with the employer to prove that first - unfortunately they're less likely to have sympathy when they could argue you took the job knowing what it was about.

I guess anything is worth a try, but is it that bad that maybe you could just start applying for other jobs while stil at this one? Maybe take a few sicks days to do it, know what I mean?

I've red through a few pages, but didn't really see an answer to my question. I've called the interstate claims office a couple times, each time a different answer. Today I asked out my time passing by as I wait for my EAD. She said the eligable weeks are ticking away as I wait, so if it takes 6 months to get my EAD thats 6 months of benefits gone. Then I asked about waiting time, a week ago they told me I still have to wait the two week waiting period once I got my EAD, plus I would have to wait out the amount of vacation pay I got as well. Which would take a couple weeks plus. Today, I was told I didn't have to wait as I have been waiting for months, and that they backdate to a certain point. A person doesn't know what to believe. I can't seem them backdating as your not eligable to work but I don't think you should lose the weeks, they say its not their fault you can work in the US, I responded, nor is it mine. Anyone actually past the waiting point that can shed some light for me without me having to read page after page after page! LOL Thanks.

I think reading some of these examples may help. Not sure of your exact situation. However in regards to the waiting period, I would anticipate that it would be the first week in which you became eligible for work in the USA.

Ok I just spent an hour reading through zyggys income tax thread from last year and am still confused a bit. I plan to file my leaving Canada return for 09 tax year as I moved to the U.S in Sept, and will be a resident alien for tax year 09 because of green card test (Just got approved for GC this month & EAD)

So my question is when you receive EI(which I'm not at the moment) is the 25% nonresident tax already taken out? If I fax a copy of my GC, they approve my claim and begin to receive EI in 2010 will I have to file a 2010 tax return with CRA for receiving EI?

I will have no other income in Canada for the year 2010, I'm thinking it would not make sense to have to file with CRA ESP if EI already has 25% nonresident tax.

Any thoughts?

Having 25% of your EI income taxed at the front end, you don't have to file a Canadian tax return. You fill out the income on your US tax return however, and indicate how much you paid in Canadian tax on that income so that you're not taxed twice. Oh yes, now that I'm re-reading your question, if you didn't know, the 25% is taken off before you get your money btw, so again, you don't file the in Canada for 2010.

Thank you Carla for your response. That was I was gathering would happen just wanted to clarify. Me + taxes= headache!

It would not make sense to have to file with CRA I will be filing my leaving canada return for 09 tax year, and no Canadian income for 2010.

The answer to your question depends on if you've applied for EI or not.

If you have applied for EI right after moving to the US......it doesn't matter if you get your EAD today or a couple months down the road. They will calculate your weeks based on the last 1 year from the day you applied for EI. (So that would be January 5th 2010 back to January 5th 2009, if you applied today) This gives you a certain amount of weeks of EI. Let's say 30 weeks. You will have 1 year to use those weeks. Chances are you will get your EAD in time to use those 30 weeks before the 1 year mark comes (January 5th 2011). Your EAD would have to take longer than 22 weeks for you to lose out on EI. (22 weeks + 30 weeks = 1 year)

If you have NOT applied for EI......yes your eligible weeks counted for EI purposes goes down. Because remember they're counting back 1 year from the "day you apply" not "your last day of work in Canada."

So the moral of the story is to apply immediately after you cross the border. Before you've unpacked your stuff, file for EI!!!

You will still have to wait 2 weeks after your EAD arrives before they start paying you. (But let them know the second it actually arrives)

In my situation, I quit my job in August 2007 and moved to the US the same month. Stupid me should have filed right away but didn't. I filed in November 2007. My ROE hours said 2200. But EI calculated it somewhere around 1600 hours (because I hadn't worked from August 2007 through November 2007). EI calculated my hours from November 2007 back through November 2006. They approved me for 27 weeks.

Received my Green card in February 2008. (It came before the EAD) Sent EI a copy of it. They waited 2 weeks and then started my 27 week claim. I had until November 2008 to use that up. My 27th week ran out in August 2008.

I would highly advise that you get your vacation pay paid out to you before you quit your job. That way it won't be used during that 2 week waiting period AND it will boost your gross income (which in turn gives you a bigger EI cheque)

im just wondering if my friend's friend who's an accountant is right. he says I am still considered a resident of Canada b/c i am collecting EI? I told him i have been in US for 252 days out of 2009. I worked until April 2009 and have no properties or assets. so when i file my canadian taxes, i have to report my worlwide income just like in US

Just a note, getting your vacation pay before you quit your job does not boost you EI cheque. Its not considered insurable earnings. Most employers, unless your part time don't like to give you your vacation pay unless you actually take the time off.

THIS IS TAKEN FROM THE CANADIAN EI SITE:

Remuneration paid with no hours attached - An employee who receives vacation pay without actually taking any leave does not generate any insurable hours. This also applies to such remuneration as bonuses, gratuities, lieu of notice payments, and retiring allowances.
