I would definatley apply for EI right away when you cross the border. I finally received my EAD and there aren't many jobs in my field here in Seattle right now, and it looks like it is going to take me awhile to find a job. Best to have a back up, because finding a job down here is not all that easy.

I am still waiting for my EI to be approved now that I sent in my proof of having an EAD. The money will be nice once it does start, living on savings is tough.

I was initially denied, but appealed and won!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

You can appeal if denied?

Is approval/denial based on discretion, so whoever happens to look at the appeal might see something differently, or...?

if u get denied, yes u can appeal! they send u letter giving u the options. I belive they are (was back in 2005, so my memory isnt hat fresh!) 1) appeal to the judge in person. 2) attend via telephone or 3) send in a letter stating ur case! We sent in a 2 page letter! I was initially denied because I was in the Cdn Air force and they stated I broke my contract to get out, which i guess was true! But I did make attempts to get posted to DC and of course in my position/job there was no way at all to get posted here! What i found interesting was that the EI lady told me on the phone that the judge had denied my appeal,BUT she over rided him and approved me!! Now being initially denied as a k1 (without an EAD) isn't grounds to appeal ( I was cr-1) that is unless u can prove a k1 has a legal right to work in the USA without a EAD! Then again, I'm not lawyer,lol

They don't actually deny you when you are on a K1 waiting for an EAD. They just put the file on hold until you can provide them with proof that you are legally able to work.

Just got a letter stating my maximum benefit is 24 weeks.. :(:lol: I think I shot myself in the foot taking 6 weeks off work earlier this spring with no pay... oh well.

Now...hurry up EAD!!!

If unpaid leave throughout the year hurts the chances... well, just one more strike against me, heh.

In total, I've had about ten weeks of unpaid vacation time this year. That and part time status for the past... four months or so.

Worth a shot either way. Extra hand to help is always good to hope for.

For christ's sake... I just wasted nearly an hour reading completely irrelevant information at the beginning of this thread.

Can someone suggest for me a good date/page number to start reading this thread to find stuff that actually applies to me? lol

I should just read backwards, and probably will after I post this, but here's my situation.

I actually have a job lined up. I'm not worried about it at all, to be honest. It's with my fiancé's place of employment (very small company). The job is basically being made up for me.

Since I just heard that we can't get EI while waiting for EAD (arrrrrrrrrrrrrrrrrgh).... and I DO have this job waiting, is there any point in me even applying for EI? Cause as soon as I get EAD I am going to start working, in which case I won't get EI.

sigh.

(after reading a bit, I see this has kinda been discussed already... I don't think I'm going to bother applying. This is really disappointing. :( )

Hey guys... don't shoot me as I am about to probably ask you some questions that may or may not have been answered. I just couldn't find them digging through this thread.

So. As a CR1 visa holder (fingers crossed) I am planning on quitting my jobs, I have two) about 2 weeks before my actual move to the US. I would really LOVE to collect my EI benefits.

So, I know that I am eligible to work as a CR1, but I won't have my green card just yet. So, what do I send in and when, to prove that I am eligible to work?

Also, when I quit both jobs, it's okay for me to say that I have quit but that I have quit to relocate to be with my American spouse?

Thanks a lot. I'll probably be here a few more times. Never done this before and it would be really helpful to be able to collect these benefits while I look for work and settle in in the US.
