Re: Employment Unauthorized.

Apply immediately anyways. Even if you don't end up getting it for those first 90 days, you'll still qualify for the maximum allowed weeks after your EAD/Green card shows up. If you wait to submit until your EAD/GC shows up you'll lose out on probably a dozen weeks if not more of your claim.

OK..

I'm an EI virgin and really had no idea about any of this (Flames, you suck) anyway! LOL ;)

So...My last day of work is Friday....I have my ROE from my last job that I worked at (about 7 months ago) and I talked to my HR dept and my HR manager is going to have my ROE ready for me before I move on the 19th.

I move exactly 1 week after my last official day. I'll be filing probably Monday the 21st once I get to the U.S.

What if I don't get the EAD stamp at the POE?

Can I fax in all the documents needed like my ROE, bank statements (do I need those), pay stubs, etc. or should I be snail mailing it all. Also, do I need to send in a copy of my marriage license?

What are these cards everyone is talking about...mailing in cards, getting cards...#######, confusion overload.

Weird...this is all so weird...I never had any clue I would even be able to do this...if I get approved, it will be awesome!

What exactly do they need to apply for EI? I anticipate moving on July 24 (if I get approved, cross your fingers) and will be applying as soon as I get there. My last day of work is July 18. I probably won't have my ROE my then but I know I can apply without it and send it later. What else do we need to apply? Do we need paystubs? Bank statements? Thanks

1) You can fill out an application online. Do this immediately after getting to your new home in the US.

2) Snail mail your ROE if you have it. Or mail it it later whenever you get it.

3) You'll probably get a one page questionnaire in the mail a few weeks later. Mail that back along with a copy of your passport showing K visa. Send a copy of your I-94 as well.

4) Every couple of weeks you'll get EI cards in the mail. These are what you fill out and return (saying if you've worked or not)

That's basically it. The EAD stamp may be necessary to work in the US. But all Canada EI wants to see is the I-94. They consider the I-94 to be a valid work permit.

Not sure what you mean, but you can't apply until your lovely self is already in the US, stamped visa and stamped I-94 in hand. I'd say beg the customs agent for an EAD stamp, and if they assure you it's the same thing the way they did to me, get it in writing from them ;)

I'm having some lovely EI drama at the moment, I'm waiting for a call back from them as they're looking for the missing parts of my file; aka the Visa and I-94 copies I SENT WITH my ROE, which they DO have.

Just got the call, it's all missing. Have to fax everything but the ROE in again RIGHT NOW. Can't find my best weeks doc. ARRRRGGGH!!!!

That seems to be one of the inconsistencies for the k1'ers--the EAD!! Depending who is looking over ur file, the EAD is not required. Read on here of many K1'ers receiving EI with no EAD stamp. And many have applied while still in the Canada.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I've been dragging the RM 00203.500 with me everywhere, and offered to send a copy to EI to support me not needing an EAD. They said they didn't need it.

I took it with me to the social security office in case I got flak when applying for my SSN, but all the girl said was "well, haven't you done your homework!" and didn't need to see it. Woot! Wasn't expecting that.

(For anyone wondering, RM 00203.500 is the social security policies document that states that K-1s are covered under "C. Policy: Employment Authorization by Class of Admission", K-1 is in that list. Helpful if anyone is giving you grief about being authorized.)

My guy doesn't get home until 30 min before the EI office closes, and I need his help to get this stuff faxed off. I'm hoping like heck he doesn't dawdle and gets his honey home STAT!

The woman I talked to today isn't the woman handling my case, but if I can get stuff into her this afternoon, she'll file it in my file so it's ready when my case handler is back in the office. I wish the nice lady who went hunting for my missing docs was the my case handler. :(

The office I had to go thru (Pictou County, Nova Scotia )would not reconize my K-1 and I-94 for EI once I was in the USA.

They told me I could not file unless I had the EAD card, which I did not have.

Needless to say they denied my appeal and had to pay back money I received after I quit my job in May/05. My ROE said moving to the USA. I drew EI from May 2 until I moved on May 25/05 and they told me I was not entitled to draw it because I quit my job.

They are full of chit.

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

I resided in NS before coming to the USA, but I didnt got hrough the local EI office, one filed through the interstate branch, which is in Ontario

I filed my EI online application yesterday. They said they need the ROE, which was submitted by my employer electronically today.

Now, I need to submit the rest of my stuff. What do I do with that terrible stamp "Employment Unauthorized" that is on my I-94? Submit it along with the RM 00203.500. Should I fax everything to them or wait until they request the documents?

April 13, 2009 - Welcome to the USA letter rec'd. PRC to be rec'd within 3 weeks.

April 16, 2009 - 2 yr GC rec'd in mail.

March 2, 2011 - Mailed in I-751 to CSC

March 4, 2011 - I-751 delivered to CSC

March 4, 2011 - NOA issued

March 12, 2011 - NOA received

April 14, 2011 - BIO Appt 5/6/11

May 6, 2011 - BIO done in 10 minutes...no re-takes this time :)

June 27, 2011 - Email rec'd "Status - Approved"

July 1, 2011 - 10 yr GC arrived

Re-apply at the Belleville, Ontario office TODAY (the interstate claims office used for out of country EI)

Nova Scotia wants you to be in Nova Scotia. Belleville is specifically for foreign people such as ourselves.

It's in red right under the Admitted and just above my last name.
