I didn't get my Record of Employment for 2 months after I left my Canadian job. They say you're supposed to file anyways even without it. I'm not quite sure how that works as there are parts on the online application that ask for ROE stuff.

Phone up the Belleville office and ask them what they think. Get their name and record the time you called. That way if there are any mistakes or whatever later, you can say yes you did ask for information.

Question: Do I need to be married before I file for EI?

I'll be crossing the border and getting the EAD at Windsor on Sunday. I can't remember if the lady at the EI office said I have to send in my marriage license? Can I just use my activated K-1 with it's EAD stamp?

I've got my ROE already, so if I don't have to get married before I can send in my application, I could do it Monday. I can't get married until Friday at the latest, and that's smack up against my 4 week limit. The EI application can be faxed in, right?

Also, what happens to my EI if my EAD expires before the AOS EAD comes through?

He also insulted my husband's motives for talking to me, dismissed our 2 years together as "not enough to get married", and otherwise trotted out the Spanish Inquisition.

02/07/2008: Filed for AOS/AP/EAD

14/07/2008: Received NOA1

09/09/2008: Transferred to CSC

29/09/2008: EAD arrives in mail w/out notice, AP following week

18/11/2008: Email notice letter has gone out, card ETA: 60 days

25/11/2008: GC arrives in mail! TWO YEARS OF RED-TAPE FREEDOM! WOOT!

You don't need to be married to start an EI claim.

If/when your 90 days expires before you get your AOS (and 99% chance it will) you won't collect during the 91st day until the time your AOS or 2 year EAD gets approved. At that time, you can resume your original EI claim.

So basically it goes:

Day 1 to Day 90 = EI claim

Day 91 to AOS or EAD approved = no EI

AOS or EAD approved = EI claim.

liz_legend 'n Ol, did you use the "best weeks" option when you filed for EI? If so, how did you fill that out without having the ROE yet?

Thanks for the reply, I was worried that if I was claiming EI due to "Relocation to be with Spouse" but then put "Single" on my martial status (as I'd still be single when I filed) it would cause problems. But I don't need to worry?

Sorry I am new here but I just want to make sure I understand this thread. If we move to the States to marry our fiance and quit our jobs we are entitled to EI? Is there somewhere on this thread exactly how to do that? Thanks so much and sorry if you have probably explained this a bazillion times! If I can collect EI that would totally help us out considering we can't work for awhile.

I'm not sure if they do that..

I had my taxes set up for direct deposit.. so they did that for my EI

it's not 100% of your previous income..

and a lot of ppl are having different experiences..

I got EI for the first 90 days i was in the US (b/c they assumed that you got your EAD stamp) and then the payments stopped til I got my EAD.

HOWEVER, someone had issues with that recently and they refused to give her payments til she had her EAD..

so.. who knows what they're doing..

As with any govt organization, its all who you speak to,lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
