hmmmmmm I can't work on my K1..in fact..I have a social security # and that states I can't work until I have my EAD..its strange..it seems some people can..and others can't..I can't even get my new drivers license until I get a reciept that says i've applied for my AOS.. **pulling my hair out** haha oh well...at least I'm with my hubby right?? i'm still trying to figure out why I can't work in these 90 days though...

We all get that SSN with the DHS authorization only bit. EI is stating that you are eligible to work because you have an unexpired I-94. Thus you are eligible for EI during those 90 days.

Now getting an employer to hire you for 90 days with just an I-94 card is the tricky part.

hahahah barely!! I think I just pulled out my last bunch! I was just out for dinner with a couple..and the husband immigrated last year from vietnam..HE was able to work when he first arrived in hawaii!! why can't I!?!?(not that I'm so desperate to work)hahaha I'm just curious why I've been given a social security card that says no..*reaching for hair to pull..oops..i'm bald now..reaching for hubbys hair to pull**..lmao!

were they married before he immigrated? if so, he probably came on a CR1/IR1 visa which is an immigrant visa which allows him to get teh real SNN card and green card as soon (well kind of) you get into the US

I was thrilled when I came across this post. I had no idea that one could carry over Canada EI out of the country. Mind you I had only one week left on an existing claim, but every penny counts and when I got my EAD, I sent all my good info to Service Canada to resume my claim and I get my final deposit on Monday. What a treat!

I am nearing my last payment of the initial 90 day period (the theoretical EAD that all K1's have :) discussed in many previous posts.

I was told by EI that my claim goes on hold at that time until I can provide proof of the real EAD or Green card. Has anyone been through this recently and did you simply fax them or give them a call and mail it to get things started again?

I JUST got the email indicating EAD card production was ordered, so I won't have much of a gap! Yippee

If you call the Belleville office of Service Canada (they handle international claims) at 877-486-1650, they will tell you what to fax in.

I faxed a copy of the card as soon as i got the card, (remember that you often receive the e-mail production card after the card was issued (ie. your card will say an even earlier date than when you got your e-mail)), and followed it up by mailing a copy of the card. Then of course I called them to say "CHECK YER FAX"!! :) Tee hee..

TY TY - no one is happier then me atm. I gave my husband my resume this morning to remind folks at his employer (they looked at my resume and liked it last Nov) that I am now close to being able to work. I would love to work in the same complex as him. 5 mins from home, nice company

Good tip about the actual effective date of the EAD card - I probably won't have any gap in EI between when my initial 90 days ended and the EAD was approved.

When did you quit? I suppose it hasn't been that long though. Is your old company sending it to your Canadian Address or your new US address directly? If it's being re-addressed using the Canada Post service, it will take and extra week or 2...I've noticed that on anything I've received...i'm in VA

Why can't your employer email your ROE to you? My employer files all our ROE's online and will email my copy to me if I go before I get it.

April 13, 2009 - Welcome to the USA letter rec'd. PRC to be rec'd within 3 weeks.

April 16, 2009 - 2 yr GC rec'd in mail.

March 2, 2011 - Mailed in I-751 to CSC

1) Even if you started your claim in Canada before you left, you need your EAD before you can start collecting this money right ??

Correct. You're on a K1 like I was...so essentially because on a K1 you *can* get your EAD when you cross the border, they consider you eligible to work. That is regardless of whether or not you actually *get* the document. I didn't, so was ineligible to work, so didn't apply. It almost cost me my benefits altogether. I would suggest that you call the toll free number posted above (I think flames9 posted it) and review your exact situation with them for timing.

2) Once you get your EAD you send a copy to EI and you start collecting from the date on your EAD and not the day you opened your claim back in Canada (which could be 2-3 months prior) ??

One of the questions you answer on the weekly timecard you send back to EI is if you were able and willing to work. Without an EAD you are unable to work. Again, because I kind of did mine backwards, I'd ask HRDC *exactly* what you need to file when.

3) You are eligible to for a maximum of 36 weeks or until you find a job ??

The amount you are paid and for how long is dependent on how much salary you were paid in a specific amount of weeks prior to not being employed. In my case, I was eligible for maximum $$ benefits but for 22 weeks total. I received 8 weeks of benefits before I started a full time job.

4) So in a sence EI is only useful for the time were you are eiligle to work in the US and are actively looking for employment there ??

Yes. Although as I said above, there's some weirdness about the K1...HRDC considers you eligible based on the K1 'theory' but in practice not every POE gives an EAD stamp when processing your K1. So if I were you I'd call and ask, using exact dates (if you have them) of when you're stopping work, when you're moving to the US, and what will happen if you get your EAD from the POE and you have work stoppage or if you don't get your EAD until after you marry and are adjusting status.

Since the old thread is disabled, I'm lost

I called EI and they said that unless I get the EAD stamp when I cross the border, my K-1 is useless to use to file because I must have permission to work, and if the K-1 gives me work status that is something I have to taken up with US immigration!

So someone please give me the bottom line before I rupture something continuing to try to arrange to cross at Windsor to try to get the stamp.

Not sure if there is a bottom line!! At one time (from readings on VJ) the k1 applicant had to have the EAD to get EI. Then some members were reporting that one no longer had to have the EAD (for K1, K3 still does) to get EI. So for the past while k1'ers were getting EI without the EAD because in Canada's EI eyes they were able to work! I didn't come in on a K1, so im not much help.

I believe you still have to file though ASAP when u enter the USA to start ur claim. I could be wrong. And if ya called back you would probably get a different answer,lol sort of like when you called the USCIS (mis)information line.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
