Hello all!

I was wondering if anyone is in AP or Administrative processing at the moment?

Me and my fiance applied for a K1 visa a while ago.  After her interview in Poland in 12/2022, they have put her case into AP.  It has been around 5 months now and still waiting.

Has anyone gone through AP recently?  How long has it taken you?  Any help or advice you can give please?

Thanks!

There are many going through it. You can search the forum for threads. Unfortunately AP has no set time. For some it is days, for others months and some are stuck there years.

Your options are:

  • waiting,
  • contacting a consgressperson to get involved or
  • file a writ of mandamus to force the embassy/ consulate into taking a decision.

Thank you for your quick response.  And, yes you are right

• We have been waiting 🙄

• I actually did contact both my state rep, and my district rep.

       - The district rep sent an email and got the same response we did, " Please wait and be patient..."

• And I think the last one would probably cause them to deny it at this point since the case is in the hands of DOS.

It seems like most cases have waited around 9 months for AP.  I was hoping to hear better news

Hi! I have a Russian fiance and I was put into AP about 2 months ago, but we interviewed in Jerusalem, not Warsaw.

Background:

My fiance has a chemical degree, previously worked in batteries, and is now a computer programmer. We got asked for a CV and military records (we forgot to take them, its just a piece of paper saying he never served).

They DID want to keep his passport after, but we explained we had to leave to obtain documents and they told us how to mail required docs to their office.

Most Russian cases, or most cases that process through Warsaw?

@rikko
We waited 10 months altogether and didn't hear anything from the embassy or AP offices in WA.

So after extensive research, we decided to go with a lawyer and file a Mandamus suit. We chose:

John Ting, Ting Law Group, (removed)

They charged us $4000 to file. They took care of everything and you are able to make monthly payments.

As soon as we filed, it only took a few days to get a response and my fiance got approved!

The whole process with the lawyers took about 3 weeks total.  My fiance has her k1 visa now and we are planning on her coming through LAX.

That's amazing news! I'm glad it finally all worked out.

Can I ask why you were given AP? Did they ask for a CV, did she have a scientific education/career?

Did you ever email the embassy and ask if your case was under active review?

It is so good to read success stories :)

@rikko they put us in AP because I develop govt technology.  I had to hire a lawyer to file a mandamus suit to get an answer.  Everytime we emailed the consulate, they just gave us a automated email saying they don’t know how long it’ll take

Thread about a now-resolved situation is closed to further comment -- OP has moved on to AOS questions (see thread in main "AOS from K Visas" forum).

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
