 The whole country is on a stand-still. The war is between the official military and paramilitary and they are fighting in the middle of the cities, airports damaged, prisoners being freed because there is no food/water to feed them, etc. They are fighting over power. Just greed!

I wonder how applying for TPS interacts with wanting a B or keeping a B?

USCIS does not see it that way.  War or other things at home doesn't waive the overstay.

people have stayed thinking it was ok  ,  then the extension was denied and the person was given an overstay (read a post on here)

probably would forgive an oversstay from Sudan but the above site is meant to help so issues don't happen

His his mother-in-law does not qualify for TPS  under the Sudan designation per the information in the site quoted in the post   (https://www.uscis.gov/humanitarian/temporary-protected-status/temporary-protected-status-designated-country-sudan).   One of the requirements is continuous presence in the US since April 19, 2022. The OP stated that his MIL arrived on December 25, 2022, clearly after that April date.  Applying for TPS under this designation would merely result in a denial and make her an overstay, subject to all the repercussions of that.

Thank you for catching that.

I have applied for extension of the visa, safest way to prevent over stay.

U.S. is her first country she has visited and her first time traveling. Why would she go to another country alone? Where she going to stay? Who is going to support her in another country? She only has a Sudanese passport no country will let her stay that long. This war will go on for a long time. 

 

Also yes it's not her fault. This war happened overnight sir. Even the U.S. and other countries were caught of guard. They never expected such thing.

 

And that's not the advice I asked for. Everyone advice was helpful except yours. You pretty much want her out the USA.

When COVID happened many people were stuck in the US (through no fault of their own)- the US didn't care. People were hit with overstays even though there were no flights out...They were told they should have left the country or applied for an extension...

Unfortunately it's the only way to stay legally it seems. Obtaining the TPS status to stay legal and then leaving on a good note is light years better explaining for the B visa. I think the B visa will still be active since TPS isn't a "non-immigrant" status like F visas are.
