I'm trying to read the instructions about the I864 on travel.state.gov but I have some points that I can't figure out.

Situation:

Ok, my sponsor (the petitioner) does not meet 125%, she is still making something so she will sponsor me. Her parents definetly meet 125% and they accepted to be a cosponsor. One of the cosponsors is selfemployed while the second is employed. My wife sponsor is employed too.

Question 1

Which forms do they have to fill out

I864, I864EZ I864W... I don't understand.

Question 2

3 years of tax returns, are these documents available at IRS offices? If they can't find them at home who should they ask?

Question 3

How much is the IV fee for NVC (CR1 visa)? 380$ or 350$ the internet site of state.gov says the latter, in the forum people payed 380$.

Question 4

Where can I download the IV fee so to get it ready to send it as soon as NVC sends it out?

Hi, I understand your situation. Go to www.uscis.gov. That is a better website.

1. Your petitioner only need to use Form I-864 and also use only one co-sponsor. The Co-sponsor uses the same form I-864 as the original sponsor/petitioner.

2. The Tax returns copies are available at the IRS. If you don't have them, give IRS a call and they'll mail them to you free. Actually, you only need the current tax i.e. 2006. For 2005 and 2004, you need only the total income made for those years since it's optional. You may decide to submit the paperwork or not but you have to slot the numbers in the boxes.

3. The IV Visa Fee is $380.00 NOT $350. I paid for three people recently.

4. You can prepare that document from elsewhere on this site but please, don't rush it. Wait if you'll take my advice. The barcode might not work if you prepare it yourself and that will delay the process for you.

As for which forms are needed, it depends.

Your wife will definitely fill out the I-864 and check sponsor.

Does either of her parents' income meet the 125% on its own? Their household number will be themselves, any dependants, plus you. If they have to combine their income to meet the 125% guidelines, one of them will fill out the I-1864 as joint sponsor (including the other's income in the total), and the other will fill out the I-1864A as a household member.

I've never heard of the I-864W and the I-864EZ only applies in situations where the main sponsor earns enough income without any assets or co-sponsors.

Your wife and her parents can request tax transcripts from the IRS for free. They shouldn't take too long to arrive. They will have to show copies of their actual W2s and/or 1099s though for 2006, which the IRS cannot provide.

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Thanks MargotDarko, yes, one of her parents meet the 125% only with income. So my wife will use I-864 and so will one of her parents. Got it, thanks a lot
