Behind on taxes, filing now but do I need to wait for tax return? [merged threads]

I haven't filed taxes for 2020, 21, 22. We have been accepted with our i-130 and getting everything in order for our interview, but I given that I haven't filed taxes and am not current I'm wondering if that will cause issues for us. I can easily file now and provide the confirmation, but it'll take 6 weeks to get the tax return and I don't want to necessarily wait that long. Can I just submit the confirmation, proof of income, and tax transcript or will it be reason for concern when we arrive at the interview? Mostly just trying to avoid the 6 weeks it takes to get the tax return and not get grilled for not being up to date on taxes.

 

Any advice?

You won't be qualified by NVC or even reach the interview without submitting tax documentation.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You can file your back taxes, then submit copies of each tax package you filed.

Thank you - so just to be clear you're saying that instead of tax returns I should upload the tax package itself and that will satisfy them? That would be great. Then I wouldn't have to wait the 6 weeks for the tax returns. I don't mind filing the taxes, just trying to avoid the delay (even though it's small and may end up being meaningless in the long run).

I am saying you must submit either copies of the tax returns (including scheduled) or tax transcripts. There are no other options.  The term "tax package" means copies of the tax returns  (along with schedules) you filed.

Just so you know, the consulate could require transcripts vs just returns, as only transcripts are proof of filing.

NVC will accept copy of 1040 with all W2's ,  or  any of the 21 different 1099's and all schedules u send in

embassy may want only the transcripts (embassy dependent)

but if u owe for any of these years,  u must show payment or agreement with IRS on a payment plan

if u are behind in child support,  that raises other issues 

 

u also  need to show filing as married the year u married and following years as u r not single those years

it  can be MFJ or MFS or Head of household if it applies in your case

Note that you "FILE" a tax return.  Many people think their refund is a "return".  It is a refund, not a return.

 

Once you have "filed" a tax return, you have a copy of it.  A complete copy is sufficient for NVC.  Under certain circumstances a Consular officer may require a Tax RETURN Transcript.  There are several "tax transcripts" but only the tax RETURN transcript is relevant to US immigration.

 

Some members (lazy typers, I guess) just type "tax transcript".  It's Tax Return Transcript.

 

For the OP, a complete copy of a tax return includes all the forms and schedules, plus W2 and 1099 forms.

Facts are cheap...knowing how to use them is precious...
