Work Denied even though valid to work

Hello everyone, 

 

So, my wife ran into a situation today and I am somewhat lost on how to handle this, other than angry. I am a US Citizen, so this is about her. My wife has an expired green card, we have filed already for I751- Petition to remove conditions of residence before it was expired, we have done everything right and keep up to date with USCIS. So, she was offered a job and today was her first day, she was called into the office and asked for her green card which is expired, and she also showed the I-797 (which the notice is dated 04/05/2023) which even stats that the validity of the green card has been extended for 48 months from the date of expiration (Her green card expired 2/2022). The sent it the information to a higher division and now they are saying that she cannot work due to her green card being expired, even though it stats there in black and white that she can work and travel. Any info helps, thank you all and God Bless.

Does she have unrestricted SSN? The one without "NOT Authorized Blas blaa blaa?"

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

People should really start suing employers for illegal discrimination in all such cases. She is entitled a compensation.

03/07/2016 AOS delivered to USCIS and signed
03/12/2016 Case received by Nebraska Service Center (NSC)
03/14/2016 Text notification received for I-140/I-485/I-765/I-131.
04/08/2016 Biometrics notice received for 04/21
04/13/2016 Biometrics early walk-in completed.
04/15/2016 EAD/AP combo card received in mail.

 

Long wait begins...

 

11/04/2016 I-140/485 cases transferred from Nebraska to TCS
12/01/2016 Prepared package for EAD/AP renewal (expires 04/09/2017)
12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
12/21/2017 Response to RFE received by USCIS 
02/09/2018 I-485 approval (text, email) :)
02/08/2018 I-485 approval notice issued (the "welcome letter") - I'm LPR now
02/16/2018 Green card received
 
11/14/2022 Filed N-400 online; receipt and biometrics reuse form received online
03/07/2023 N-400 Interview scheduled 
04/xx/2023 N-400 approved, same-day Oath ceremony completed. I'm a US citizen.
05/xx/2023 US passport in hand

Not really sure I would move to litigation immediately.  Not all employers are up-to-speed on documents, etc., I would do what the others here have suggested first, and then if the company still held the line, maybe consider a lawsuit.

She should be good with the extension letter even if the ssn is restrcted.

N-400 online April 27, 2022 base on 3 years rule, biometric reused.

N-400 interview on December 12, 2022 combo interview i-751. Approved.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

January 13, 2023 apply for us passport.( regular service).

Timeline

HR are not known for understanding the rules of the I-9 very well, especially for people with permanent residency or work authorization/visa.  Politely show HR the I-9 instructions and follow @Chancy's instructions above.  

 

Interestingly, I was time wasting on TikTok yesterday and an employment lawyer video popped up and she quickly spouted off how MANY employers break the law because they forget there are federal laws in place governing what needs to happen and they break them all of the time.  She said she'll never be unemployed as a result.

I second this.. Combo List B doc (driver license) + List C (expired GC and extension letter) would do; subject the HR is aware :)

Should have removed this as soon as you got the GC.

this is the reason i want to get unrestricted SS card ( still battling with SSA office for 2 weeks ) + state ID instead of using the expired GC with extension letter because there's bunch of HR out there who doesnt know about this.

Sue them and then get another job. That's an ignorant employer
